Özet
İflasına karar verilen şirketlerde şirket yetkililerinin tasarruf yetkisikısıtlanmaktadır. İflas kararından önceki dönemlere ait olan vergilemeve ceza kesme işlemi söz konusu olduğunda tebligatın kime yapılacağıve dava açma yetkisinin kime ait olacağı konusunda bir belirsizlik ortayaçıkmaktadır. Bu belirsizliğin giderilmesi için yasal düzenleme yapılmasıgerekmektedir.
Abstract
In companies which have been court order to be bankrupt, the power of action of company managers is restricted. Uncertainty arises when it comes to taxation and penalty imposition, which belong to the periods before the bankruptcy court order. This uncertainty is about to whom the notification will be made and who will have the authority to sue. Legal arrangements are required to eliminate this uncertainty.
