Özet

İcra ve İflas Kanunu çerçevesinde asliye hukuk mahkemelerininyargı çevresinde örgütlenen icra daireleri, bu kanun hükümleriyle taşınırveya taşınmaz malları cebri icra yoluyla sattığında, 3065 sayılı KatmaDeğer Vergisi Kanunu m.1/3-d’e göre katma değer vergisi konusunagiren bir işlem gerçekleştirmektedir. Katma değer vergisinin yapısı gere-ği icra daireleri söz konusu satış ile katma değer vergisinin kanuni mü-kellefi, verginin yansıtılabilmesi özelliği ile de vergi yükünün katlanıcısıalıcı, fiili mükellefi olmaktadır. İcra dairesinde yapılan satış işlemi iletahsil edilen katma değer vergisine dair bir uyuşmazlık ortaya çıktığındaise bu işlemin yargısal denetiminde görevli yargı kolunun belirlenmesisorunlu bir alan açmaktadır. Çalışmamızda, icra dairesinde satış ile do-ğan katma değer vergisine dair sorunların çözümünde hangi yargı kolu-nun görevli olması gerektiği hususu ele alınmaktadır.

Abstract

The executive offices of the legal courts of the jurisdiction of the jurisdictional courts within the framework of the Execution and Bank- ruptcy Law carry out a transaction that falls under the value added tax law in accordance with the Value Added Tax Law No. 3065 1/3 - d, when the movable or immovable property is sold by the law. Execution offices which are subject to the structure of the value added tax are the legal taxpayers of the sale and value added tax, and the taxpayer is the buyer and de facto taxpayer of the tax burden with the ability to reflect the tax. When a dispute arises about the value added tax collected by the sales transaction made in the execution house, the determination of the judicial branch in charge of judicial control of this process opens a problematic area. In our work, it is dealt with which jurisdiction should be in charge of solving the problems of value-added tax arising from sales in execution offices.
