Özet
Serbest bölgeler, bir ülkenin siyasi sınırları içinde olmakla birlikte gümrük sınırlarının dışında tutulan bölgeler olarak tanımlanmaktadır. Serbest bölgelerin ülkelere sağlayacağı faydalardan birisi de ülke ekonomisini ferahlatacak ölçüde istihdam etkisi yaratmaktır. Serbest bölgelerde çalışma ve sosyal-güvenlik hakkının yabancılara hangi ölçülerde tanınacağı hususunda ülkemizin diğer bölgelerine kıyasla farklılık arz eden bir durum mevcut değildir. Çünkü serbest bölgelerde konuya dair esaslar, Türkiye Cumhuriyeti Çalışma Mevzuatına tabi tutulmuştur. Bu doğrultuda yabancı gerçek kişiler yönünden vasıflı uzman personel olma koşulunun aranarak daha ziyade serbest bölgelerde yerli işgücünden istifade edilmeye çalışıldığı; yabancı tüzel kişiler yönünden ise kendi ülkelerinde kuruluş işlemlerini tamamlayarak faaliyetlerini hâlen yurt dışında sürdürmekte olan şirketlerin, faaliyet ruhsatı almak kaydı ile serbest bölgelerde çalışma hakkı elde ettiği görülmektedir.
Abstract
Free zones are defi ned as zones held outside the customs borders as well as being inside a country’s political borders. One of the benefi ts that the free zones will provide is the creation of employment at a measure that will relieve the country economy. There is no difference concerning the degree of labor and social security rights entitled to the foreigners at the free zones in comparison with the other regions of our country since the principals of this issue at the free zones are subject to the Labor Regulations of the Republic of Turkey. For these reasons, it is observed that local labor power is trying to be used preferably by looking for the requirement of the personnel being skilled specialists among the real foreign persons. From the point of the foreign legal persons, it is seen that the companies which have completed their foundation procedures and are continuing their own activities in their home countries do also obtain the right of working at the free zones with the condition of obtaining an activity license.
