ADALET, SİYASET VE İYİ YÖNETİM: LİBERALİZMİN SÖYLEMSEL TAHAKKÜMÜNE BİR İTİRAZ

Özet
Son zamanlarda, özellikle de John Rawls’ın “Bir Adalet Kuramı” adlı eserinin yayımlanmasının ardından, siyaset felsefesi tartışmalarının merkezine oturan “adalet”in neliğine (mahiyetine) dair gerek insanlık tarihi boyunca farklı kültürler arasında gerekse de çağdaş tartışmalarda bir uzlaşıya varılamamış olması, bu kavramın özü itibariyle tartışmalı olduğu fikrini güçlendirmektedir. Bununla birlikte, bütün toplumlarda siyasal söylemin merkezinde yer almış olması ise adaletin ilgili toplumlarda oynadığı kritik rolü ya da işlevi öne çıkarmaktadır. Dolayısıyla, kültür-bağımlı bir değer olması nedeniyle, evrensel düzeyde mahiyeti itibariyle tanımlanamayan adaletin işlevi itibariyle tanımlanabileceği iddia edilebilir. Adaletin bu evrensel işlevi, tarihî tecrübenin gösterdiği üzere, iktidarı sınırlandırmaktır. Tarih boyunca bütün toplumlar iktidarın sınırlandırılması işlevini, kamusal düzenin kaynağı olan iktidarın temerküzü kadar önemli addetmişlerdir; zira, sınırlandırılmamış bir iktidar insanların kişisel hak ve özgürlüklerini baskılayarak, onların insanî varoluşlarını tehdit etmektedir. Dolayısıyla, insanlık tarihi boyunca bütün toplumlar, bir yandan kamusal düzenin tesisine, yani siyasal iktidarın bir merkezde yoğunlaşmasına yönelik adımlar atarken, diğer yandan adalet kavramını siyasetin merkezî unsuru addetmek suretiyle temerküz etmiş iktidarı bireyler lehine sınırlandırmaya çalışmışlardır. Yine bütün toplumlarda, bu iki şartın eş zamanlı varlığı “adalet düzeni” ve “iyi yönetim” olarak yüceltilmiştir. Modern dönemdeki “iyi yönetim” anlayışı da aslında belli bir dünya görüşü ve tarihsel bağlam içerisinde oluşan bu adalet düzeni dengesidir.
Abstract
Justice, which has recently –particularly after the publication of Rawls’ A Theory of Justice– come to the center of the debates in political philosophy seems to be an essentially contested concept. The lack of universal consensus accross times and places on the whatness or essence of justice reinforces this idea. On the other hand, the centrality of justice in the political agenda of all societies underlines the role it plays in politics, which is the limitation of governmental power. It is a well-known fact that consolidation or concentration of governmental power for the emergence of public or political order is a necessity. Hence, all societies in history looked for physical and symbolic means for power to be concentrated in one center. Simultaneously, howevcer, these societies also searched for the means of limitation of power in order to protect individual human beings against the possible aggressions or abuse of governmental power. Eventually, the idea of justice came to play a key role in balancing the weight of the concentrated power. This point of balance between the consolidation and limitation of power is known as “the order of justice” and “good governance”. The vision of political order in modern times or the model for “good governance” relying on modern liberal values is nothing but the order of justice providing the above-mentioned point of balance in modern Western societies. Taking into account the historical process of reaching this point of balance and the functions it plays in modern societies, however, this liberal model should not be considered the unique form of good governance or more valuable than other historical models rleying on different worldviews. This, however, does not mean that the modern institutional inventions or mechanisms, which have nothing to do with a certain worldview, should be neglected at all. On the contrary they can be mobilized in the service of different worldviews and value systems.
