Özet

Bu makale, Thomas Hobbes’un The Elements of Law (1640), Leviathan (1651) ve Behemoth (1679) kitaplarındaki savaş, savaş hali ve iç savaş kavrayışları- nı ele almaktadır. T. Hobbes makalede üç düzlemde değerlendirilmektedir. İlk olarak, T. Hobbes ve J-J. Rousseau’nun çatışan savaş kavrayışları açısından bir okuma gerçekleştirilmektedir. İkinci olarak, Hobbes’un adil savaş geleneğin- den koparak savaş “hipotezini” geliştirmesi ele alınmaktadır. Üçüncü olarak ise Hobbes’un savaş hipotezi ile iç savaş arasında kurmuş olduğu içsel bağ irdelen- mektedir. Böylelikle makalede amaçlanan, Hobbes’un ontik savaş kavrayışının, çağdaş dünyadaki yasa krizini düşünmek için sağlam bir teorik zemin oluştur- duğunu göstermektir. Buna göre artık, Hobbes’un tasarladığı anarşik dünya res- minden çıkış, sadece devletin düzenini tesis etmesiyle mümkün değildir. Politik düzenin mantığı açısından, Leviathan ve Behemoth figürleri aynı iktidar pratiği- nin farklı yüzleridir. Bu doğrultuda bu makale, yasa ve anarşi resimlerinin içsel bağı açısından, barış ve iç savaşların – hatta Schmittyen bir yorumla dünya iç savaşının, birlikte düşünülmesinin zorunlu olduğunu savunmaktadır.

Abstract

The aim of this article is to provide a critical discussion of the concepts of war, state of war, and civil war in Thomas Hobbes’ The Elements of Law (1640), Leviathan (1651), and Behemoth (1679). T. Hobbes is being evaluated on three bases in this study. Firstly, it has been discussed the conflicts in terms of conception of war between Hobbes and Rousseau. Secondly, it was continued with war ‘hypothesis’ which is revealed by Hobbes by breaking just war tradition. Thirdly, the inner connection between Hobbes’ war hypothesis and civil war is examined. Hence, the main purpose of this article is to indicate Hobbes’ conception of the ontic war which is a solid theoretical base to think about the law crisis in the contemporary world. Accordingly, Hobbes design for a way out of the anarchic world picture is no longer possible just by establishing the state’s order. Leviathan and Behemoth figures are the different facets of the practice of power in terms of the logic of political power. The inner ties of law and anarchy pictures, peace and civil wars –even with Schmitt’s interpretation of the world civil war– must be considered together.
