Özet
İnternetin günlük hayatın vazgeçilmez bir unsuru olması ile birlikte birçok ticari faaliyet internet üzerinden yürütülmeye başlanmıştır.Mobil internetin de gelişmesi ile birlikte aplikasyon teknolojilerinin yoğun olarak kullanılması sonucunda mal ve hizmet sunanlar ile tüketicileri bir araya getiren platformlar ortaya çıkmıştır. Bu platformlardan sonyıllarda en çok tartışılanlarından biri ise şehir içi yolcu taşımacılığı alanında faaliyet gösteren Uber isimli uygulamadır. Yıkıcı yenilik olarakadlandırılan piyasa modeli, bir taraftan tüketicileri çekerken diğer taraftan çok sayıda mevcut yerleşik hukuk kuralını ihlal ettiği gerekçesi ileeleştirilmektedir. Bu makalede platform ekonomilerinin, Uber örneğiözelinde, rekabetçi piyasa açısından yarattığı sorunlara değinilmektedir.Uber uygulamasına karşı ilk önce lisans alma başta olmak üzere taksitaşımacılığı kurallarına uymadığı ve bu nedenle de haksız rekabet hükümlerine aykırı davrandığı yönünde çok sayıda dava açılmıştır. Benzerbir dava da Türk Ticaret Kanunu’nda düzenlenen haksız rekabet hükümlerine aykırı davrandığı için Türkiye’de açılmış ve halen devam etmektedir. Diğer taraftan Uber uygulaması üzerinden iş yapma modeli Rekabetin Korunması Hakkındaki Kanun’un uygulanması açısından da birçok tartışma barındırmaktadır. Bu makalede Uber özelinde platform ekonomilerinin yarattığı rekabet sorunları incelenecektir.
Abstract
After the internet being an indispensable part of our daily lives, many commercial activities are being carried out on the internet. With the development of mobile internet and the frequent use of the application technologies, online platforms that bring together goods/services and consumers have emerged. One of the much-debated of these platforms in recent years is Uber, which operates inner-city passenger transportation markets. The new market model, based on disruptive innovation, attracts consumers in on one hand but on the other hand it is being criticized on the grounds that it violates numerous situated rules of law. In this article, the problems arising from the platform economies in terms of competitive market are being discussed. Numerous lawsuits were filed against Uber due to its incompliance with the rules such as licensing and violation of unfair competition provisions of the law. A similar lawsuit has been filed against Uber in Turkey due to its incompliance with the unfair competition provisions of Turkish Commercial Code; the lawsuit is still ongoing. On the other hand, the model of doing business through the Uber application contains many debates about the implementation of the Law on the Protection of Competition. This article aims to address competition problems arising from platform economies specific to Uber.
