UNDERSTANDING OF SOVEREIGNTY IN THE ESTABLISHMENT OF SOCIAL ORDER AND FREEDOM OF THE INDIVIDUAL ACCORDING TO THOMAS HOBBES

Özet

Throughout history, many political philosophers have mediated the formation of social order by disseminating several ideas on concepts of state, sovereignty and liberty. Thomas Hobbes is one of the political philosophers who lived between 1588 and 1679 and constituted the foundations of the conception of nation-state, with typologies of "law of nature" and "social contract". Hobbes argued that the egalitarian and absolute free state in which man is born causes a constant war situation because of endless will of men for glory, fame and desire. He believed that human being in the state of nature will benefit eveyone if he transfers all of his freedoms to an absolute and sovereign power in return of protection of his security and rights. In spite of the absolute liberty of the state, Hobbes put forward only the freedom of the individual's right to live. Hobbes, espousing that although the state is not responsible for anything it does, individuals implement its commandments unconditionally for solitary and integrity of the state and emphasized that Leviathan's sword is sharp and reckless to the social disorder by expressing that the covenants without the sword are but words. In this context, literature search has been done on Thomas Hobbes' thoughts for state, sovereignty and individualism, and besides Hobbes' sense of sovereignty, it is desired to show the importance he gave to the independence of the individual which remains in the background. It is clear that Hobbes is a strict defender of the traditionalist and absolutist state structure. However, it is forgotten that this thought of Hobbes is valid for as long as the state fulfills its duty and is loyal to the contract. If the state does not fulfill its duty and is not subject to the contract, the individual is responsible for protecting himself and his rights. In this study, the state's responsibilities towards the individual for the continuation of the sovereignty of the state will be examined in terms of Hobbes.

Abstract

Liberty Tarih boyunca birçok siyaset felsefecisi devlet, egemenlik ve özgürlük anlayışı üzerine birbirinden farklı fikirler yürüterek toplumsal düzenin oluşturulmasına aracılık etmiştir. Thomas Hobbes 1588 - 1679 yılları arasında yaşamış, “doğa yasası” ve “toplum sözleşmesi” tipolojileriyle ulus devlet anlayışının temellerini oluşturan siyaset felsefecilerinden birisidir. Hobbes, insanın doğduğundaki eşit ve mutlak özgür halinin, bitmek bilmeyen şan, şö hret, arzu ve istekleri nedeniyle devamlı savaş haline neden olduğunu ileri sürmüştür. Doğa durumundaki insanın güvenlik ve haklarının korunması karşılığında tüm özgürlüklerini tek ve mutlak egemen güce devretmelerinin herkese fayda sağlayacağı düşüncesind edir. Hobbes, devletin mutlak özgürlüğüne karşı bireyin sadece yaşam hakkı özgürlüğünü ön plana çıkarmıştır. Devletin yaptığı hiçbir şeyden sorumlu olmamasına karşın, bireylerin devletin bir ve bütünlüğü için onun buyruklarını kayıtsız ve şartsız yerine ge tirmesini benimseyen Hobbes, kılıcın zoru gösterilmedikçe ahitlerin sözlerden ibaret kalacağını ifade ederek toplumsal düzensizliğe karşı Leviathan’ın kılıcının keskin ve sorumsuz olmasını vurgulamıştır. Bu çerçevede Thomas Hobbes’un devlet, egemenlik ve b ireye yönelik düşünceleri ile ilgili literatür taraması yapılmış olup Hobbes’un egemenlik anlayışının yanında arka planda kalan bireyin özgürlüğüne yönelik verdiği önem bu çalışmayla gösterilmek istenmiştir. Hobbes’un gelenekçi ve mutlakiyetçi devlet yapıs ının katı savunucusu olduğu açıktır. Lakin Hobbes’un bu düşüncesi devletin görevini yerine getirip sözleşmeye sadık kaldığı müddetçe geçerli olduğu unutulmaktadır. Devlet, görevini yerine getirmez ve sözleşmeye tabi olmazsa birey kendini ve haklarını korum akla görevlidir. Bu çalışmada devletin egemenliğinin devamı için devletin bireye karşı sorumlulukları Hobbes açısından irdelenecektir.
