THE PROBLEM OF OVERPOPULATION IN PENITENTIARY INSTITUTIONS AND DISCUSSIONS ON PARDON

Özet

Cezaevleri tüm dünyada olduğu gibi Türkiye’de de her zaman sorunlu kurumlar olmuşlardır. Ceza infaz kurumlarının sorunlarının belirlenerek, bunlara çözüm bulunması ve hükümlülerin cezalarının infazı sonunda topluma yeniden kazandırılmaları gereklidir. Gerçekten de, cezaevlerindeki insanların sorunlarına duyarlı kalarak, onların kendi içimizden çıkan insanlar olduğu ve bir gün aramıza tekrar dönecekleri unutulmamalıdır. Kaldı ki, her insanın olduğu gibi, bizlerin veya bir yakınımızın en azından ölümle sonuçlanan bir trafik kazası sonucunda ya da başka bir nedenle tutuklu veya hükümlü olarak infaz kurumlarına girme ihtimali olduğu hiçbir zaman göz ardı edilmemeli ve ünlü Alman yazar Hans Fallada’nın “Ayyaş” isimli eserinde ifade ettiği gibi, “içeri girmenin, dışarı çıkmaktan kolay olduğu” unutulmamalıdır.

Abstract

Prisons in Turkey have always been problematic institutions as such all over the world. The problems of the penitentiary institutions shouldbe identified and solved, and the convicts must be reintroduced to the society at the end of the execution of their penalties. Indeed, by taking into consideration prisoners’ problems, it should not be forgotten that prisoners belong to our society and they will return to this society. Moreover, it should never be overlooked that there is a possibility for every person, as for us or for one of our acquaintances, to be put in the penitentiary institutions as a detainee or a convict due to a traffic accident resulting in death, or for any other reason, and it should be noted that it is“easier to get in than out” as the famous German writer Hans Fallada stated in his book “The Drinker”.
