MEİS, KARAADA VE FENER ADASI'NIN DOĞU AKDENİZ DENİZ YETKİ ALANLARI SORUNUNA MUHTEMEL ETKİLERİ

Özet

Türkiye’nin Kaş/Antalya bölgesinde, kıyının hemen karşısında yer alan Meis, Karaada ve Fener Adası, kendi aralarında bir ada grubu veya bağlı adacık değildirler. Bilakis, bu adalar, Doğu Akdeniz’in müstakil nitelikteki adalarındandırlar ve Anadolu yarımadasının da doğal sualtı uzantısı üzerindedirler. Bununla birlikte, Meis ile birlikte bu iki müstakil ada, son on yılda Doğu Akdeniz’e damgasını vuran deniz yetki alanları sorununun üçüncü taraflarca nadiren ilgi ve dikkat çeken, genelde görünmez ama güçlü aktörleridir. Zira Yunanistan egemenliğindeki Meis’e karşılık, egemenliği tartışmalı statüdeki Karaada ve Fener Adası’nın Yunan egemenliğinde olması ve adalara karasuları yanında ilave deniz yetki alanları tanınması durumu, Doğu Akdeniz’de kıta sahanlığı ve münhasır ekonomik bölgenin sınırlandırılmasında Türkiye ve KKTC’nin pozisyonunu zayıflatabilecek ve aynı ölçüde Yunanistan ve GKRY’nin pozisyonunu kuvvetlendirebilecektir. Bu bağlamda, bu çalış- manın ana amacı, söz konusu üç bağımsız Akdeniz adasının tartışmalı hukukî statüleri ile bunların Doğu Akdeniz deniz yetki alanları sorunundaki yerlerini ve muhtemel etkilerini irdelemek ve ortaya koymaya çalışmaktır

Abstract

Megisti, Rho and Hypsili which locate just across the coast in the Kaş/ Antalya province of Turkey are not a group of islands or adjacent islet. On the contrary, these islands are independent islands of the Eastern Mediterranean and lay on the natural sea-shelf of the Anatolian peninsula as well. However, these two independent islands together with Megisti as rarely attracting interest and attention of the third parties, are usually unvisible but robust actors of the Eastern Mediterranean maritime jurisdiction areas conflict. Apart from Greek-Megisti, the situation which necessitates that Rho and Hypsili whose sovereignities are disputable are under Greek sovereignty and entailed to have additional maritime jurisdiction rights beside territorial waters might have negative impacts on Turkish and Turkish Cypriots position, while strenghtening the Greek and Greek Cypriots position. In this respect, the main aim of this study is to analyze and put forward the disputed judicial status of these three independent Mediterranean islands and their places and possible impacts on the Eastern Mediterranean maritime jurisdiction areas conflict.
