Özet
Yabancı hukukun tespiti ve uygulanması, MÖHUKun 2. maddesinde düzenlenmiştir. Ayrıca Yabancı Hukuk Hakkında Bilgi Edinilmesine İlişkin Avrupa Konvansiyonunun yanı sıra Türkiyenin yaptığı adli yardımlaşma antlaşmalarında da bu konuda hükümler yer almaktadır. Çalışmamızda, MÖHUK, milletlerarası antlaşmalar ve Yargıtay kararları kapsamında yabancı hukukun tespiti ve uygulanması konusu irdelenecektir. Ayrıca farklı uygulamaları yansıtmak üzere, yabancı hukukun tespiti ve uygulanmasına ilişkin olarak bazı devletlerin mevzuatları da incelenecektir.
Abstract
The ascertainment and application of f oreign law is addressed in article 2 of the Turkish Private International Law and Procedural Law Act. Further, the European Convention on Inf ormation on Foreign Law and the j udicial cooperation treaties signed by Turkey also contain provisions on this matter. This article explains the identif ication and application of f oreign law pursuant to Turkish PILA and the relevant international treaties as well as decisions of the Court of Cassation. In addition, with a view to clarif ying diff erent practices, we also present an assessment of the legislation of certain states relating to the identif ication and application of f oreign law.
