Abstract

The obligation to provide "fair and equitable treatment" is often stated concurrently with other standards aimed at ensuring the protection of foreign direct investment by host countries. It is an "absolute" and "non-contingent" standard of treatment, that is, a standard that defines the treatment that must be given whose exact meaning remains to be determined in the specific context of application, unlike the "relative" standards embodied in the principles of "national treatment" and "most favored nation", which define the treatment required in comparison with the treatment accorded to other investment.
