Özet
Hakem kararları özel hakimler olan ve bir devlet adına hareket etmeyen hakemler tarafından verilir. Dolayısıyla, onların verdiği kararın etkisi bu karara muhtelif hukuk sistemlerinin atfedeceği değere bağlıdır. Bu konuyu Tunus hukuku açısından tartıştığımız bu makalede bu konuyla ilgili değişik yönleri ele alıyoruz ve oluşum aşamasında olan bir hukuk siyasetinin altını çiziyoruz. Tunus hukukunun hem mevzuat hem de içtihatla ilgili yönü dikkatle incelendiğinde, hakem kararlarını olumsuz yönde etkileyecek mekanizmaları sınırlandırarak bu kararların tanınma ve tenfizlerini kolaylaştırmayı amaçlayan bir trendin oluştuğu görülmektedir.
Abstract
The arbitral award is rendered by private judges, arbitrators, who do not act on behalf of a sovereign state. As such, the effectiveness of their award depends on the authority that will be conferred on them by different legal orders. In order to discuss this matter from the Tunisian law point of view, in this article, we examine the distinctive features that govern this matter and highlight a judicial policy which is under perpetual construction. A careful assessment of Tunisian law, both on legislative and jurisprudential fronts, reveals this trend, more and more assertive, to promote the recognition and enforcement of arbitral awards as well as their effectiveness by limiting the remedies that are available against those awards.
