Özet
Tahkim yargılamasında yapılacak yazılı bildirimler bakımından iç hukukumuzda iki ayrı kanunda düzenleme bulunmaktadır. 1086 sayılı Hukuk Usulü Muhakemeleri Kanununda esasen bu yönde herhangi bir hüküm yer almadığı hâlde, içtihatlarda, tereddütsüz bir biçimde Tebligat Kanununa atıf yapılmıştı. 6100 sayılı Hukuk Muhakemeleri Kanununun 438/I. maddesinde ise bu kez Tebligat Kanununa atfen açık bir hüküm getirilmiştir. Ne var ki, tahkime ilişkin söz konusu hükümler, yerli/iç tahkimde geçerlidir. Yapılan atfın sınırları ve kapsamı ile tahkimde hangi iş ve işlemler için geçerli olduğu konularında anılan hüküm, yoruma ve açıklamaya muhtaçtır. Milletlerarası tahkim bakımından 4686 sayılı Milletlerarası Tahkim Kanununda, başkaca hiçbir kanuna atıfta bulunmaksızın; doğrudan bu kanunda özel hüküm getirme yolu tercih edilmiştir. Yazılı bildirim/tebligat ile ilgili meseleler, hukuki dinlenilme/bilgilenme hakkıyla yakından ilgilidir. Kime, nerede, nasıl ve ne zaman tebliğ yapıldığı konuları, özellikle tebliğe bağlanan hukuki sonuçların doğumu açısından büyük önem arz etmektedir. Bu sebeple çalışmamızda Tebligat Kanunu ve tahkim mevzuatımızda yer alan diğer hükümlerin tahkimde nasıl uygulanacağı meselesi ele alınacaktır.
Abstract
In our local law, there are two Acts that contain provisions concerning written notifications to be made in the course of arbitral proceedings. Although the previous Civil Procedure Act No. 1086 did not contain explicit provisions in this regard, the jurisprudence consistently referred to the Notifications Act. As to the new Civil Procedure Act No. 6100, its article 438/I explicitly cross-references the Notifications Act. These provisions, however, are only relevant to domestic arbitration. The cited provision of the Civil Procedure Act is unclear and needs interpretation and clarification as to the extent and scope of the cross-reference and the kinds of actions undertaken in the arbitral proceedings which it covers. As far as international arbitration is concerned, the International Arbitration Act No. 4684 contains special provisions, and does not cross-reference any other Act. Notification issues are closely related to the procedural principle of the right to be heard. To whom, where, how and when a notification is sent are issues that are highly important, particularly with respect to the legal implications of the notification. Therefore, in this study, we discuss the application in arbitral proceedings of the notification provisions in our Notifications Act and the Arbitration Legislation.
