Özet

Toplumsal yaşamı düzenleme amacı güden hukuk normlarında yer alan hükümler arasında bir çatışma olmaması gerekirken, bazı durumlarda aynı ihtilafa uygulanabilen hükümler arasında çatışmalar ortaya çıkabilmektedir. Bu çatışmalar, genellikle; birbiri ile tamamen çelişen iki hükmün varlığından ziyade, uygulamada bu hükümlerden hangisine üstünlük verileceği sorunsalı olarak ortaya çıkmaktadır. Hukuk uygulamasında bu çatışmaların giderilmesi için önemli ilkeler benimsenmiş ve uygulanmıştır. Bunlardan lex specialis derogat lex generalis ilkesi, özel hükmün genel hükme göre öncelikli olarak uygulanacağını, dolayısıyla özel hükmün genel hükmü bertaraf edeceğini kabul etmektedir. Ancak aynı ihtilafa uygulanabilen hükümler arasında bu şekilde bir bertaraf edici ilişkinin bulunması mutlak bir sonuç değildir. Bu gibi hükümlerin, kimi zaman hak sahiplerine seçimlik bir alan yarattığı da ayrıca tespit edilmektedir. Türk deniz ticaret hukukunun asli normu olan Türk Ticaret Kanunu’nda yer alan hükümler de diğer normlarda yer alan bir takım hükümlerle, bu anlamda bertaraf edici ya da seçimlik ilişki içine girmektedir. Çalışmada; bu hükümleri tespit etmek ve seçimlik ilişkilerin varlığı durumunda, seçimi makul hükümleri işaret etmek amaçlanmaktadır.

Abstract

Even though there should be no conflicts between the articles which are placed in the legal norms which aim to regulate the social life, in some cases, conflicts arise between the articles that are applicable to the same debate. Generally, these conflicts arise as a problem in the application priority, other than the existence of the two articles in total contradiction. In the law practice, important principles have been adopted and applied in order to override these conflicts. Lex specialis derogat lex generalis principle is one of these principles, which admits that the special article; will have the application priority over the general article and thus, derogate the application of the general one. However, derogation is not the absolute consequence of the relationship between the articles which are applicable to the same debate. It is also determined that such articles create an alternative area to the right holders. Some articles in Turkish Commercial Code which is the essential norm of Turkish maritime law have such derogative or alternative relationship with the articles placed in the other norms. In the study, it is aimed to; determine these articles and point the conceivable ones which might be selected in the existence of such alternative relationships.
