Özet
Cumhurbaşkanı 2014 yılında Türkiye Cumhuriyeti'nde ilk defa halk tarafından seçilmiştir. Daha önceki Cumhurbaşkanları millet iradesinin dolaylı yolla temsili ile milletin vekilleri tarafından seçilmişlerdir. Her ne kadar dolaylı temsil yolu ile Cumhurbaşkanlığı seçiminde halk iradesini kullanmıştır denilse de, ne yazık ki siyasi güç odakları ve seçim dönemindeki güç dengeleri de seçim süreçlerine dâhil olmuşlar ve halkın iradesi ikinci planda kalmıştır. Ülkemizde 31.05.2007 tarihli 5678 sayılı Kanunla yapılan değişikliğe kadar, Cumhurbaşkanı meclis tarafından bir defa için yedi yıllığına seçilmekteydi. Ancak 2007 de yapılan değişiklikle Cumhurbaşkanı halk tarafından en fazla iki defa 5 yıllığına seçilmesi kararlaştırılmıştır. Ayrıca seçim süreci, aday olunmaya ilişkin şartlar ve seçim yönteminde ciddi değişiklikler olmuştur. Bu çalışmada birbirinden farklı olan bu seçim düzenleri ve aralarındaki farkları açıklamakla beraber, Cumhurbaşkanlığı seçimine hakim olan ilkeleri de açıklamaya çalışacağız.
Abstract
President of the Republic of Turkey was elected by the people for the first time in 2014. Previous presidents of the republic, with indirect ways of representing the nation will have been selected by the nation's representatives. Although by way of indirect representation in the presidential election have used the will of the people, unfortunately, the balance of power in the election period, and have been included in the electoral process and the will of the people remained in the background. The Republic of Turkey in 2007 until the changes to the Constitution, the President was elected by parliament once for seven years. However, amendments to the Constitution in 2007 president it was decided to select a maximum of two terms of 5 years by the people. In addition, the selection process, the conditions for a candidate, the election process and was in serious changes. In this study, this selection scheme which is different from each other and their differences and principles which dominates the presidential election will be explained.
