Özet
Teknolojik gelişmelerin çalışma hayatında meydana getirdiği yeniliklerden en önemlisi zaman, mekân veya kişi bakımından klasik sözleşme türlerine göre farklı yapıdaki yeni çalışma ilişkileridir. Platform çalışma modeli üst başlığı altında sayılan “Crowdworking” ise son yıllarda ortaya çıkan yeni bir kavram olup, yararlarının yanı sıra birçok sakıncasının da bulunduğu gerekçesiyle özellikle Almanya’da sıklıkla tartışılmaktadır. Bu makalenin temel amacı, crowdworking çalışma modelinin genel olarak tanıtılması ve özellikle İş Hukuku bakımından ortaya çıkarabileceği etki ve sorunların tespitidir. Bu çerçevede çalışmamızda crowdworking çalışma modeli türleri, yararları ve sakıncaları, çalışma şartları bakımından özellik arz eden durumlar, organizasyon yapılanması ile İş Hukuku bakımından doğurabileceği sorunlar üzerinde durulacaktır. Son olarak ise crowdworking çalışma modelinin hukuk güvenliği kapsamına alınması için ileri sürülen öne-riler ile görüşümüze yer verilecektir.
Abstract
The most important novelty in working life brought by technological developments is the new working relations that differ from the classic contract types in terms of time, place or person. Classified under the main title of platform working; “Crowdworking” is a new concept that has emerged in recent years, and it is frequently discussed, especially in Germany, on the grounds that it has many drawbacks as well as advantages. The main purpose of this article is to introduce the crowdworking model in the general and identify the effects and problems it may cause especially in terms of the Labour Law. In this context, our study will focus on the types, advantages and drawbacks of the crowdworking model, issues that require sensitivity in terms of working conditions, problems that may arise in terms of the organizational structure and Labour Law. Finally, suggestions that are put forward to include the crowdworking model in the scope of legal security and our opinions on the matter shall be examined.
