THE EVALUATION OF THE LEGISLATION CONCERNING THE AUTHORISATION OF PUBLIC EMPLOYER ORGANISATIONS BY THE SUB-CONTRACTORS

Özet

Türk iş hukukunda son yıllarda kamu kesiminde ihaleler yoluyla çalıştırılan işçilerin yaşadıkları sorunlar büyük bir yer tutmaktadır. Son olarak 6552 sayılı kanun ile kamu kesiminde hizmet alım ihaleleri kapsamında çalıştırılan işçilerle ilgili düzenlemeler getirilmiştir. Bunlardan biri de kamu kesiminde hizmet alımı ihalesi kapsamında çalıştırılan işçilerin toplu iş sözleşmelerinin akdedilmesi için alt işverenin kamu işveren sendikasına yetki vermesi ile ilişkilidir. Bu düzenlemenin Anayasa'ya ve iş hukuku mevzuatına uygunluğu çeşitli açılardan incelenmesi gereklidir.

Abstract

In the recent years the problems of the workers who are employed by sub-contractors of the public sector employees constitutes one of the great subjects of Turkish labour law. Lately the law numbered 6552 has severeal articles about these workers. One of these articles is related with the authorisation of the public sector employer organisations by the public sector's sub-contractor in order to conclude a collective agrrement for these workers. This article needs to be examined in various aspects in the light of Constitution and labour law legislation.
