Özet

Taraflar arasında kişisel bir ilişki kurması nedeniyle iş sözleşmesinde tarafların birbirine olan güveni, özellikle işverenin işçiye olan güveni, sürekli nitelikte olan bu sözleşmenin devam edebilmesi için önemlidir. İşçinin, esaslı bir şekilde iş sözleşmesinden doğan yükümlülüklerini ihlal etmesi veya işverene ya da işyerine karşı suç niteliğinde bir eylemde bulunması halinde işveren, iş sözleşmesini haklı veya geçerli nedenle sona erdirebilir. Ancak işçinin esaslı bir şekilde iş sözleşmesini ihlal ettiği veya işverene ya da işyerine karşı suç niteliğinde bir eylemde bulunduğu ispat edilemeyip, ortada sadece güçlü ve giderilemeyen bir şüphe mevcut olabilir. Böyle bir durumda şüphe feshi gündeme gelecektir.Bu çalışmanın ilk bölümünde şüphe feshinin ne olduğu, hukuki niteliği, hangi koşullarda hukuken geçerli kabul edileceği, suçsuzluk karinesiyle ilişkisi gibi konular, özellikle kavramın doğduğu Alman hukukundaki kararlar ve doktrin ışığında ele alınacaktır. İkinci bölümde ise Türk hukukunda şüphe feshine ilişkin Yüksek Mahkeme kararları, birinci bölümde yapılan tespit ve varılan sonuçlar çerçevesinde değerlendirilecektir.

Abstract

Mutual trust and confidence in contracts of employment, especially the employers' trust and confidence in employees, are of importance regarding the formation and continuation of such continuing performance contracts as they create a personal relation between the parties. Employers may terminate employment contracts for valid reason or for just cause in case of essential breach of obligations arising from employment contracts or misconducts that constitutes criminal acts against employers or workplace. However essential breach of obligations arising from employment contracts or criminal acts against employers or workplace may not be proven and there may only be strong and unavoidable suspicion. In such cases dismissal on ground of suspicion will come up. First chapter of this study examines the concept and legal character of dismissal on ground of suspicion under which conditions it will be considered valid, its relation with the presumption of innocence etc. especially in the light of jurisprudence and doctrine of German law where this concept was born. At the second chapter, judgments of Turkish Court of Appeal regarding the dismissal on ground of suspicion will be evaluated within the scope of the findings and conclusions of the first chapter
