İSLAM HUKUK METODOLOJİSİNDE FIKHÎ BİR İCTİHAD YÖNTEMİ OLARAK TE’VİL

Özet

Genel olarak İslâm düşüncesinin oluşum süreçlerinde etkili olan yöntemle-rinden biri te’vildir. Dilde yaşanan anlam kayması kapsamında terim anlam kazanan ve fıkıh usulü içerisinde ictihâdın bir yöntemi olarak değerlendirilen te’vilin füru‘ fıkhının şekillenmesinde önemli bir rol oynadığı hususunda şüp-he yoktur. Bu yönüyle te’vil hem klasik hem de onların özeti mahiyetindeki muasır usul eserlerinde yer bulmuştur. Dolayısıyla umûmun tahsisi, mutlakın takyidi, emrin vücûb yahut nedbe, nehyin tahrim yahut kerahete delâleti ve lafzın hakikat yahut mecaz yönü gibi fıkhî istinbâtta etkin olan hususlar aynı zamanda te’vile de zemin oluşturmaktadır. Ayrıca me‘âni harflerinin delâlet boyutları ile teâruz durumunda nasların te’lifi de te’vil kapsamında değer-lendirilmektedir. Bu bağlamda umûm-husûs, nakil-iştirâk ve izmâr-nakil gibi lafız-manâ ilişkisine dayalı hususlar arasındaki teârüzü gidermek için değişik te’lif yöntemlerinden söz edilebilir. Çalışmamızda te’vil, bir ictihâd yöntemi olarak ele alınmış, usul ve fıkıh eserlerinde yer bulan somut fıkhî uygulama örnekleri üzerinde değerlendirmeye tabi tutulmuştur.

Abstract

Ta’wil is one of the most influential methods in the formation processes of Islamic thought in general. In the context of semantic changes and shifts of meaning in languages, ta’wil has gained an important place and is considered as a rational method of ijtihad within the fiqh method and it also has an im-portant role in shaping the furû‘u’l-fıkh. In this respect ta’wil has been includ-ed in both classical and contemporary style works that are summary of them. Therefore, the allocation of the âm (general) word, the taqyid of the abso-lute word and the understanding of the word in a metaphorical sense and of its true meaning and to be sufficient to express the aim or the need for ad-miration, the establishment of a new matter in the judiciary or emphasizing the previous meaning that are effective in fiqh reference, applying the order in the sentence with taraduf or tebâyün direction form the basis for the ijti-had of ta’vil. In addition to these, the meaning of the letters rich meaning di-mensions, it is evaluated reconciliation of nas within the scope of ta’wil. In this context, there are different methods of scholars to resolve the apparent theo-rem among the issues based on the liaison-meaning relationship, such as gen-eral-private, cem’-nesih, joint-metaphor, allocation-izmar and izmar-transfer.In this study, ta’wil is considered as a rational ijtihad method and is evaluated on concrete fiqh practice examples found in the works of fiqh.
