Özet

Bugün insanlığın ve dünya medeniyetinin karşısında duran en temel sorun hiç şüphesiz yoksulluktur. İşin ilginç yanı ise toplumsal çatışmaların odağında yer alan bu sorunun kıtlık ya da kaynak yetersizliğinden değil tam tersine varlıklardaki toplam artışa karşın gelir dağılımındaki bozulmalardan kaynaklanmasıdır. Dünya giderek zenginleşirken, görece çok az sayıdaki insan dışında insanların geneli fakirleşmektedir Bu tablonun daha da ilginç ve bir o kadar korkutucu boyutu ise gelir dağılımındaki adaletsizliğin azalmak yerine giderek artması eğilimidir. Bu durumu, uluslararası kuruluşlar çarpıcı rakamlarla ortaya koyarken Oxfam tarafından yapılan güncel bir çalışmada sadece 8 zenginin dünya varlıklarının yarısına sahip olduğu ifade edilmiştir. Sistemsel yozlaşmalara ve toplumsal çöküntülere neden olabilecek huzursuzluk verici bu tablonun sosyo-politik temeline ilişkin en önemli alanlarından biri vergi sistemleridir. Günümüz dünyasında gelir adaletinin tesis edilebilmesi, yaratılan refahın mümkün olduğunca adil şekilde dağıtılabilmesi için kullanılabilecek en önemli araçların başında vergi gelmektedir. Ancak, gelişen teknolojik imkânlar verginin bu işlevini giderek sorgulanabilir hale getirmekte, tam tersine vergiden kaçınma için yeni olanaklar sunmaktadır. Günümüzde, toplumların tekrar barış ve istikrar içinde yaşamasının en önemli unsuru olan adaletin tesisi için adil ve kabul edilebilir bir vergi sisteminin yeniden gözden geçirilerek inşası gerekmektedir. Bu gerekliliğin en somut örneklerinden biri internet üzerinden yapılan faaliyetlerin vergilendirilmesi sorununda karşımıza çıkmaktadır. Nitekim, giderek daha fazla hacim kazanan elektronik ticaret klasik ticarete karşı rekabet üstünlüğü ve esneklikler nedeniyle piyasayı bozucu etkilerinin yanı sıra vergi sistemlerinin bu yapıları kavrama konusundaki yetersizlikleri nedeniyle vergi gelirlerine yönelik tehdit oluşturmaktadır. Bu sorunun çözümü için öncelikle cevap aranması gereken soru ise mevcut yapı içinde interneti vergilendirmenin mümkün olup olmadığıdır. Bu çalışmada, bu sorunun cevabı aranırken bu alanda yapılması gerekenler de irdelenecektir

Abstract

Without any doubt, the most threatening social and economic risk for the humankind and world of modernity is poverty. The interesting part of the story is that the reason behind this central point of many social problem is not lack of source or scarcity but unfair distribution of income contrary to the increase in the gross wealth. While very limited number of people in the world is getting richer, the rest is gradually becoming poorer. The worrisome fact about this situation is the degree of injustice regarding income distribution tends to become greater. This problem is highlighted by the striking statistics provided by international organizations, one of which is Oxfam’s current study that reveals only the wealth of 8 richest people is almost equaling the half of gross wealth in the world. This worrisome picture could potentially cause systemic corruptions and social meltdowns; moreover, it is closely related to tax systems due to its sociopolitical roots. In our contemporary world, to establish a fairer income distribution and to maintain an acceptable allocation of welfare among citizens the most appropriate instrument is tax. However, ever-developing means of technology cast doubt on allocation function of tax systems and locate “tax fairness” in the center of arguments by providing new opportunities for tax avoidance. Nowadays, tax systems should have been reviewed and redesigned from a fairer perspective and in an acceptable fashion to establish the justice, which is the soul of society as a major factor of social peace and stability. A concrete reason for this necessity is the current taxation problems regarding commercial activities through internet and digital platforms. The volume of e-commerce in the market moving up quickly to the detriment of classical trade due to the competition advantageous depending on cost efficiencies and flexibilities. On the other hand, the deficiency of classical tax systems to cover the e-commerce activities creates a risk over the marker by accelerating the competition disadvantageous and loss of tax revenue. For the solution of this problem, the key question that needs to be answered is whether the digital activities could possibly be taxable under current legal system. In this paper, the problem regarding taxation of e-commerce will be discussed and after an overall evaluation some alternative approaches with some solutions will be presented to address this problem
