Bu çalısmada, “ahzu kabz” yetkisi, gerek 1086 sayılı (eski) Hukuk Usulü Muhakemeleri Kanun’u (“HUMK”) hükümleri, gerekse bu yetkiye iliskin özel bir düzenleme içermeyen 6100 sayılı (yeni) Hukuk Muhakemeleri Kanun’u (“HMK”) sistemi bakımından mukayeseli olarak incelenmistir.

Abstract

This essay examines the concept of “collecting power” (as a right to collect a certain amount of money or a specified commodity) according to provisions of the (previous) Code of Civil Procedure of 1927 (“HUMK”) as compared to the system of the (new) Code of Civil Procedure of 2011 (“HMK”), which does not include any provisions with respect to collecting power.
