İDARENİN ÖZEL FAALİYETLERİNİN ANAYASAL TEMELLERİ ÜZERİNE KURAMSAL BİR SORGULAMA

Özet

İdarenin kamu yararı amacı içeren idari faaliyetleri bulunmasına rağmen, uygulamada iktisadi ve ticari girişimler içeren kimi özel faaliyetlerine de rastlanılmaktadır. İdarenin temel işlevine yabancı nitelikteki bu özel faaliyetlerinin anayasal ve kuramsal temellerinin sorgulanması gerekmektedir. Konu, idarenin temel amaç ve görevleriyle de çok yakından ilgilidir. İdarenin özel faaliyetleri daha çok Devlet ve diğer kamu tüzel kişilerinin hak ehliyetine sahip olmalarıyla açıklanmaya çalışılmaktadır. Ancak, Devlet ve diğer kamu tüzel kişilerinin sadece hak ehliyetine dayanarak özel faaliyette bulunabilmeleri, "idarenin kanuniliği ilkesi"yle çelişmektedir. Anayasa Mahkemesi ve Danıştay, idarenin özel faaliyetlerinin de kamu yararı amacıyla gerçekleştirildiğini belirterek bunları iktisadi ve ticari nitelikli kamu hizmeti saymaktadır. Bununla birlikte, idarenin kamu hizmeti niteliğinde olmayan özel faaliyetlerinin olamayacağı şeklinde bir görüşü temellendirmek güç olduğu gibi; kamu hizmeti niteliğinde olmayan özel faaliyetlerinin olabileceği şeklinde bir görüşü temellendirmek de aynı ölçüde güçtür. Her iki görüşün temellendirilmesi, ön kabulleri gerektirmektedir. Bu ön kabuller kaçınılmaz olsa dahi, tartışmaya açılmalarında, hukuksal meşruiyetlerinin sorgulanmasında ve böylece idarenin özel faaliyetlerinin, anayasal temellerinin irdelenmesinde yarar vardır

Abstract

Although there are administrative activities which contains purpose of public interest, in practice private activities that contains some economic and commercial activities of the administration are also observed. It is necessary to question the constitutional and theoretical foundations of these commercial activities foreign to the basic function of the administration. The subject is also very closely related to the main aims and tasks of the state and administration. The private activities of the state are mostly tried to be explained by the fact that state and other public corporate bodies have capacity to have rights. However, the principle that public corporate bodies may conduct private activities based on their capacity to have rights is contradictory to “the principle of legality”. The Turkish Constitutional Court and the Turkish Council of State, on the other hand, determine that there is a public interest in the private activities of the administration and regard these as public services of economic and commercial quality. However, it is difficult to establish a view that the administration cannot render private activities without public services; it is equally difficult to establish an opinion that the administration may have private activities which are not public services. The basis of both views requires preliminary assumptions. Although these assumptions are inevitable, it is useful to be open to debate, to question their legitimacy in law, and to examine at least the constitutional bases of the administration's private activities
