Özet

AB’nin 11-12 Aralık 1999 tarihindeki Helsinki Zirvesi’nde aday ülke olarak kabul edilmesinden sonra Türkiye, insan hakları mevzuatında AB standartlarını benimsemeye hız verdi. AB Uyum Yasaları ile düşünce ve ifade özgürlüğünün kapsamı genişletildi. Bu kapsamda Türkiye işkence ve kötü muamelenin önlenmesi konularında da önemli ilerlemeler sağladı. Ulusal Program önceliklerine göre “İşkence Yasağı” konusundaki Uyum Yasalarının düzenlemelerinin incelenmesi hakkındaki bu çalışmada, AB Uyum Yasalarının İlerleme raporlarında yapılan eleştiriler ışığında Türkiye’de “İşkence Yasağı” alanındaki gelişmelere yaptığı katkı ortaya konulmaktadır.

Abstract

After the acceptance of Turkey as a candidate for membership in EU Helsinki Summit, on 11-12 December 1999 Turkey began to accelerate the adoption of its human rights regulations to the EU standards. With the EU Adjustment Laws, scope of freedom of thought and expression was broadened. In this context, Turkey has also made substantial progress by adopting harmonization packages concerning prevention of torture and maltreatment. This study about the examination of the regulations of Adjustment Laws in the field of ‘‘Prohibition of Torture“ according to the National Programme priorities, reveals how the EU Adjustment Laws contributed to the improvement in the field of ‘‘Prohibition of Torture“ in Turkey in the light of critics stated in the Progress Reports.
