BAZ İSTASYONUNUN FAALİYETİNDEN KAYNAKLANAN HUKUKÎ SORUMLULUK HAKKINDA BİR YARGITAY HUKUK GENEL KURULU KARAR İNCELEMESİ

Özet
Yargıtay 4. Hukuk Dairesince, 2003 yılından 2011 yılına kadar baz istasyonlarının kaldırılması taleplerine ilişkin aynı doğrultuda kararlar verilmiştir. Buna karşılık, 2011 yılından itibaren ise Yargıtay 4. Hukuk Dairesinin görüş değiştirerek farklı kararlar verdiği görülmektedir. Bununla birlikte, Yargıtay 4. Hukuk Dairesi ile Yargıtay Hukuk Genel Kurulunun da baz istasyonlarını konu alan davalarda aynı görüşte olmadıkları görülmektedir. Bu sebeple çalışmamızda, 30.05.2012 tarihli ve 4-147/327 sayılı Yargıtay Hukuk Genel Kurulu kararı incelenmek suretiyle, fikir ayrılıklarına ve tartışmalara yol açan baz istasyonlarının kaldırılması konulu davalara açıklık kazandırılmak istenmiştir. Bu doğ- rultuda, baz istasyonlarının faaliyetinin maddî-manevî tazminat davaları ve eski halin iadesi (müdâhalenin meni) davasına konu olup olamayacağı ile baz istasyonunun maliki ile işleteninin hangi hukukî sorumluluk sebepleri doğrultusunda sorumlu tutulabilecekleri değerlendirilmiştir.
Abstract
Decisions related to the demands about the removal of the base station have been given in the same direction by The Forth Civil Panel of the Supreme Court of Appeals from 2003 up to 2011. However, it is seen that, by changing the opinion, The Forth Civil Panel of The Supreme Court of Appeals have given different decisions since 2011. In addition, it is also seen that, The Forth Civil Panel of The Supreme Court of Appeals and The General Board of The Supreme Court of Appeals arent holding the same opinion about the cases of the base stations. Therefore, in our study, by being examined the decision of The General Board of The Supreme Court of Appeals the date of which was 30.05.2012 and which was numbered as 4-147/327, the cases about the removal of the base stations that cause disagreements and debates have been expected to be clarified. In this respect, whether the activity of base stations will be the subject of the material-moral compensation cases and a possessory action or not and which legal liability reasons the owner and the operator of the base station will be responsible for, have been evaluated.
