Kerâhet Vakitlerinde Namaz Kılınması Konusuna Usûlî Yaklaşım

Özet

Namaz İslam’ın temel ibadetlerinden biridir. Bu ibadetin Şâri‘ tarafından belirlenen sınırları, sahih olarak yerine getirilmesinin nasıllığı, fıkıh literatüründe önemli yer tutmaktadır. Birçok meselede olduğu gibi namaz vakitlerinin tespitinde fakihler arasında görüş farklılıkları bulunmaktadır. Fakihlerin farklı görüş belirttikleri meselelerden biri de namaz vakitleriyle ilintili kerahet vakitleridir. Bu farklılıklar, bu konuda nakledilen rivayetlerin fakihlere ulaşıp ulaşmamasından kaynaklanabildiği gibi bazen de rivayetleri yorumlarken fakihlerin esas aldıkları usûlî kaidelerden kaynaklanabilmektedir. Bu nedenle bu çalışmanın amacı kerahet vakitleriyle ilgili görüş farklılıklarını ve bunların dayandıkları usûlî esasların incelenmesi, fakihlerin bu konuda farklı hüküm verme nedenlerinin ortaya konması ve bu hükümlere varırken izlemiş oldukları yöntemleri tespit etmektir. Bu nedenle namaz vakitleri, namaz vakitlerini tayin eden rivayetler, bu rivayetlerin hamledildiği manalar ve bunun sonucunda fakihlerin vakitlerle ilgili ulaştıkları/vardıkları görüşler incelendi.

Abstract

The prayer is one of the basic worships of Islam. The framework of the boundaries determined by Shari of this worship, how to perform correctly has an important place in the fıqh literature. As in many issues, there are differences of opinion among the jurists in the determination of prayer times. One of the issues that the jurists set different views on is the prayer times related to kerâhet. These differences may arise from whether the narrations conveyed in this regard reach the jurists or sometimes they may arise from the procedural rules that the jurists take as a basis when interpreting the narrations. Therefore, the aim of this study is to examine the differences of opinion about the times of kerâhet t and the procedural principles on which they are based, to determine the reasons for different judgments of the jurists and to determine the methods they have followed in reaching these provisions. In the study, prayer times, narrations that determine the prayer times, the meaning of these narrations and the meaning of the jurisprudence of the jurists, the opinions about the times were examined.
