ÇOCUKLAR İÇİN SEVGİ HAKKI MUKAYESELİ BİR İNCELEME

Özet

Çocukluk dönemi en uzun süren ve bu dönemde en uzun süre dış tehdit ve etkiye maruz kalan varlık insandır. İnsan kişiliği, sosyal çevre ve maruz kaldığı davranışlarla çocukluk döneminde şekillenmektedir. Çocuğun sağlıklı gelişimi için sıcak, huzurlu ve sevgi dolu bir aile ortamı, sağlıklı ve yeterli beslenme, iyi bir eğitim kurumu, vb. birçok ihtiyacının karşılanması gerekmektedir. Hukuki anlamda çocuğun diğer ihtiyaçlarına ilişkin yapılmış birçok çalışma ve kanuni düzenleme varken ne yazık ki çocuğun sevgi ihtiyacı üzerinde yeterince durulmamıştır. Sevgisiz bir ortamda büyüyen çocuğun diğer ihtiyaçları karşılansa bile istenen fayda elde edilemeyecektir. Biz bu çalışmamızda çocukların maddi ve manevi gelişiminde beslenme kadar etkin bir rol oynayan sevginin Anayasal bir düzlemde bir hak olarak çocuklara tanınması amacıyla Sevgi hakkının çerçevesini ve önemini ortaya koymaya çalışacağız.

Abstract

The period of childhood of human beings lasts longer than other beings and in this period they are subjected to external threats and influences. Human personality is shaped in childhood through childs social environment and behavior. A peaceful and loving family atmosphere, healthy and adequate nutrition, a good educational institution, etc. is necessary for the healthy development of the child. There are many studies and legal arrangements concerning the other needs of the child, but unfortunately the child’s need for love has not been sufficiently addressed ın the legal sense. Even if the other needs of the child growing up in a loveless environment are provided, the desired benefit will not be achieved. In this study, we will try to reveal the framework and the importance of the right to love plays an active role in the material and spiritual development of children in order to give love to children as a right in a constitutional plane.
