Özet

Vicdanî ret kısaca, kişinin inancı gereği zorunlu askerlik hizmetinden kaçınmasıdır. Hukukî açıdan uluslararası literatürde vicdanî ret, din ve vicdan özgürlüğü açısından bir insan hakkı olarak değerlendirilmektedir. Günümüzde, demokratik olarak tanımlanan pek çok ülkede vicdanî ret bir insan hakkı olarak tanımakta ve yurttaşlarına askerlik hizmetine alternatif oluşturan kamu hizmeti seçeneği sunmaktadır. Bu çalışmada, 2018 yılında Economist Dergisi tarafından yayınlanan demokrasi indeksine göre dünya üzerindeki bazı ülkelerde vicdanî ret uygulamalarının nasıl olduğu ortaya konmaya çalışılacaktır. Bu kapsamda rapora göre öncelikle işleyen demokrasinin hâkim olduğu ülke olan Almanya, kusurlu demokrasinin hâkim olduğu ülkeler olan Amerika Birleşik Devletleri, Meksika ve Şili, karma rejim hâkim olduğu ülke olan Rusya ve Türkiye son olarak otoriter rejimin hâkim olduğu ülkeler olan Angola ve Eritre’nin vicdanî retle ilgili uygulamaları ortaya konmaya çalışılacaktır.

Abstract

Conscientious objection is simply to refrain from compulsory military service as a person's belief. From a legal perspective, in the international literature, conscientious objection is considered as a human right in terms of freedom of religion and conscience. Today, in many countries which is defined democratic, that recognize conscientious objection as a human right and offer citizens the option of public service as an alternative to military service. In this study, it will be tried to show how the perception of conscientious objection in some countries around the world according to democracy index wich was published by Economist. In this context, the practices of conscientious objection of the Germany, the countries where the dominant democracy dominated, the practices of conscientious objection of United States of America, Mexico and Chile, the countries in which the defective democracy prevailed, the practices of conscientious objection of Russia and Turkey, the country in which the mixed regime prevails, and the practices of conscientious objection of Angola and Eritrea, which are the countries dominated by the authoritarian regime, will be tried to be explained.
