Özet

Ücretli ev hizmetlilerinin sayısı günümüzde pek çok nedenden ötürü artmıştır. Ev hizmetlilerinin çalıştıkları ve barındıkları yer aynı olduğundan bu kişilere zorlu çalışma ve yaşam koşullarının dayatılması kolaylaşmaktadır. İşin doğasından kaynaklanan birtakım güçlüklerin yanı sıra, ev hizmeti piyasası aynı zamanda dezavantajlı bir sektördür. Kölelik ve kulluk, pek çok kişi tarafından geçmişe ait uygulamalar olarak tanımlansa da günümüzde de varlıklarını devam ettirmektedirler. AİHS’in 4. maddesi bir yandan, kölelik ve kulluğu yasaklarken, diğer yandan da zorla çalıştırma ve zorunlu çalışmayı ele almaktadır. Çalışmamızda başta AİHM kararlarından yola çıkarak maddede yasaklanan kölelik, kulluk, zorla çalıştırma ve zorunlu çalışma kavramlarının tanımları ortaya konmaya çalışılacak; ardından ise Mahkemenin bu alanda Sözleşmeci Devletlere yüklediği pozitif yükümlülükler üzerinde durulacak ve çeşitli ülkelerdeki bu alandaki gelişmelere değinilecektir.

Abstract

The number of paid housekeepers has increased has increased for many reasons nowadays. It is difficult to keep domestic service under control. Since the domestic housekeepers work and shelter at the same place, and usually do not have other colleagues, it is easier to impose tough working and living conditions on them. Besides the difficulties in the nature of the business, the industry itself is a disadvantageous sector at the same time. Although slavery and servitude are defined by many as past practices, they still exist today. Article 4 of the ECHR, on the one hand, forbids slavery and servitude, while on the other hand it deals with forced and compulsory labour. In this study, we will try to put forward the definitions of the concepts of slavery, servitude and forced and compulsory then the positive obligations that the ECtHR places on the Contracting States and the developments in this area in various countries will be addressed.
