Özet

Kamu mallarından yararlanma, genel yararlanma ve özel yararlanma usulleri çerçevesinde iki türlüdür. Bu yararlanma yöntemlerinin aksine, kamu mallarının büyük bir bölümü ise geçerli bir hukuki sebebe dayanmaksızın işgal edilerek kullanılmaktadır. Kamu taşınmazının işgal edilmesi nedeniyle, idarece, işgalin tespiti tarihinden geçmişe doğru beş yılı geçmemek üzere ecrimisil talep edilmektedir. Bu çalışmada, bu beş yıllık sürenin hukuki niteliği tartışılmıştır. Diğer yandan, bir kamu alacağı olarak ecrimisil, tarh-tebliğ-tahakkuk ve tahsil aşamalarında uyuşmazlıklara konu olmaktadır. Bununla beraber, tahakkuk aşamasında açılan davada yürütme durdurulmamışsa, tahsil aşamasına geçildiğinde ödeme emrine karşı yeni bir dava açılmaktadır. Böylece, aynı ecrimisil alacağı ile ilgili farklı mahkemelerde görülen iki dava ortaya çıkmaktadır. Bu çalışmada, bu sorunun giderilmesine yönelik de önerilerde bulunulmuştur.

Abstract

Use of public property is possible through public and private use procedures. Despite these procedures, the majority of public properties are used by means of occupation, without any legally valid reason. In cases where a public property is occupied, mesne profits respecting a period which is not exceeding 5 years from the detection of the occupation backwards are claimed by the administration. In this study, the legal nature of this 5-year period is examined. On the other hand, mesne profits, as public claims, are subject to disputes in the phases of assessment, notification, accrual, and collection. If a stay of execution was not granted in the litigation, which was filed during the phase of accrual, a new case to contest the order of payment is filed in the phase of collection, therefore resulting in two separate lawsuits with the same subject matter but heard by two separate courts. Suggestions to overcome this problem are also made in this study.
