Özet

Kurucu Meclis olarak 23 Nisan 1920’de açılan Türkiye Büyük Millet Meclisi, bir yandan askeri alanda Kurtuluş Savaşı’nı yürütürken, öte yandan da kurulacak yeni Türk Devleti’nin hukuki statüsünü hazırlamak için çalışmalara başlamıştır. Erken Cumhuriyet dönemi olarak adlandırabileceğimiz bu dönemde Büyük Millet Meclisi, 20 Ocak 1921’de 1921 Anayasası’nı kabul etmiştir. 1921 Anayasası çok açık bir şekilde, birinci maddesinde, egemenliğin kayıtsız şartsız millete ait olduğunu kabul etmiştir. Anayasa ulusal kurtuluşsavaşı döneminin ihtiyaçlarına cevap veren, kısa, 24 maddeden oluşan bir anayasa olup, içeriğinde yargıya ve temel haklara ilişkin düzenlemelere yer vermemiştir. Ne var ki, dönemin halkçılık düşüncesinin etkisiyle yerel yönetimleri de düzenleyen bir anayasadır. Bu anlamda, yarıdan fazla maddesi ile mülki yapıyı düzenleyen bu anayasa anayasacılık tarihimizde, katılımcı yerel demokrasiye değer atfeden, müstesna bir anayasadır. 1921 Anayasası katılımcı yerel demokrasi ve kurumlarını düzenlerken, siyasal özerkliğe dayanan federalizmi tercih etmemiştir. Üniter devlet ilkesi çerçevesinde, devletin idari yapısı ile ilgili kuralları düzenlemiştir. Anayasa yeni milli, üniter Türk devletinin adını da Türkiye Devleti olarak hukuksallaştırmıştır

Abstract

As a constituent assembly, The Grand National Assembly of Turkey which had been opened on 23 April 1920 had started to work to prepare the legal status of the new Turkish State on the other hand while conducting the War of Independence in the military field.In this period, which we can call the early republican period, The Grand National Assembly adopted the 1921 Constitution on January 20, 1921. The 1921 Constitution clearly statesin article one that the sovereignty belongs unconditionally to the nation. The Constitution is a constitution consisting of 24 short articles which responds to the needs of the national liberation struggle period and does not include the judiciary and regulations on fundamental rights in its content. However, it is a constitution that regulates the local governments under the influence of populism. In this sense, this constitution, which regulates local authority with more than half of the constitutional articles, in our constitutional history, it is an exceptional constitution which attaches importance to participatory local democracy. While the 1921 Constitution regulates participatory local democracy and institutions, it did not favor federalism based on political autonomy. Within the framework of the unitary state principle, it has regulated the administrative structure of the state. The constitution legalized the name of the new national, unitary Turkish state as the state of Turkey
