AN ASSESSMENT OF THE QUESTION OF WHEN THE NEWLY ELECTED ASSEMBLY WILL USE ITS AUTHORITIES IN TURKISH LAW

Özet

Kanun-i Esasi’den itibaren, 142 yıllık parlamento geleneğine sahip olanTürkAnayasa Hukukunda yasama kuvveti parlamento tarafından kullanılmaktadır. Yasama organı da çeşitlisüreçlerden geçerek bugünkü halini almıştır. Bu süreçte, 1876 Kanun-i Esasi’de olmasa da 1921 ve 1924 Teşkilat-ı Esasiye Kanunlarında Meclisin sürekliliği ilkesini kabul edilmiştir. Aynı şekilde 1961 ve 1982 Anayasaları da bu ilkeyi kabul etmiştir. İşte bu noktada eski Meclis görevinin ne zaman sona ereceği ve yeni Meclisin görevinin ne zaman başlayacağısorunu ortaya çıkmaktadır. Yeniseçilen Meclisin yetkilerini kullanmaya başlayabileceği anın tespiti, yasama meclisinin icraatlarına başlayabilmesi açısından son derece önemlidir. Yapılan incelemede doktrinde iki farklı görüş tespit edilmiştir. Bu görüşlerden bir tanesi, “Seçilen yeni Meclisin yetkisi, Meclisin seçilmesi ile başlar” şeklindedir. Diğer görüşe göre ise, Meclisin seçilmişsayılması ve yetkilerini kullanmaya başlaması gereken anın, “ilk olarak toplandığı zaman” olduğu belirtilmektedir. Çalışmada bu görüşler değerlendirilerek sonuca ulaşılmıştır.

Abstract

The legislative poweris used by the parliament in theTurkishConstitutional Law, which has 142 years of parliamentary tradition since the 1876 Constitution (Kanun-i Esasi).The legislative body passed through various processesto gain the presentstate.In this process, except the 1876 Constitution, the 1921 and 1924 Constitutions (Teşkilat-ı Esasiye Kanunu) accepted the rule of continuity of the Assembly. Likewise, the Constitutions of 1961 and 1982 accepted the principle of continuity of the Assembly. At this point, the question arises: When does term of office of former assembly end and when the new Assembly’s task begins? The moment when the newly elected Parliament begin to use its powers is of great importance in terms of enabling the legislative body to begin its activities. Literature scanning method was used asthe method ofstudy. Two different views have been identified in the review of the literature. One of these views is that “the authority of the new Assembly begins with the election of the Assembly”. According to another opinion, the moment for being elected and able to use its legislative powers is “the first convention time of the Assembly”. By evaluating mentioned views, the conclusion was obtained.
