MİRASTAN FERAGAT SÖZLEŞMESİNİN MİRASÇILIK BELGESİNDE GÖSTERİLMESİ

Özet

Miras bırakan bir mirasçısı ile ivazlı ya da ivazsız olarak mirastan feragat sözleşmesi yapabilir. Böyle bir durumda, mirastan feragat eden mirasçılık sıfatını kaybeder. İvazlı mirastan feragat, sözleşmede aksi öngörülmedikçe feragat edenin altsoyunu da kapsar. Mirastan feragat sözleşmesi, belli bir kişi lehine yapılabilir. Feragatin belirli bir kişi lehine yapılmış olması halinde, feragat edenin payı bu kişiye ait olur. Mirastan feragat sözleşmesi belli bir kişi lehine yapılmamışsa en yakın ortak kökün altsoyu lehine yapılmış sayılır. Mirastan feragat sözleşmesinin varlığı halinde, bu sözleşmenin hüküm ve sonuçlarının mirasçılık belgesinde gösterilip gösterilmeyeceği hususu tartışmalıdır. Mirasçılık belgesinin işlevi ve bu belge olmaksızın mirasçıların tereke üzerinde herhangi bir resmi işlem yapamayacağı dikkate alındığında, tartışmanın açıklığa kavuşturulması uygulama bakımından oldukça önemlidir.

Abstract

The testator may conclude an inheritance renunciation contract with an heir with or without valuable consideration. In such a case the renouncing party is not deemed to be an heir on succession. An inheritance may be renounced in favour of certain persons. If certain persons are named in the renunciation contract as heirs, the part of the renouncing heir belongs to these. If certain persons are not named in the renunciation contract as heirs, the renunciation is presumed to be effective only in respect of the heirs of the line descending from their nearest common ascendant. In case of inheritance renunciation contract, it is not clear whether the effects and consequences of this contract will be indicated in certificate of inheritance. In terms of practice it is important to clarify the matter. Because the heirs are not able to make any official transaction on the estate without certificate of inheritance.
