Özet

Kamu Yönetimi Temel Kanunu Tasarısıyla kamu yönetim sistemi yeniden tasarımlanırken, bu sürecin parçalarından birisini de denetim alt sistemi oluşturmaktadır. Kuşku yok ki, denetim alt sisteminin kendine özgü bir çok sorunu vardır. Bunun başta gelen nedenlerinden birisi, sistemin kendisinden çok, çalıştırılmasıyla ilgilidir. Makalede, kamu kesimindeki genel denetim sorunlardan hareketle. Tasarı üzerinden denetim sisteminde getirilmek istenen değişiklikler inceleme konusu yapılmaktadır. Buna göre, başlangıçta denetimin kuramsal bağlamı ortaya konulmakta ve kamu denetim sisteminin şimdiki işleyişi ile sorunları makro bakışla ele alınmaktadır. Sonrasında ise, Tasarı ile getirilmesi beklenen yeni denetim modeli sistemci bir yaklaşımla çözümlenmeye çalışılmaktadır. Tasarının denetim alanında hem kapsam hem de yöntem bakımından köklü bir farklılaşma getirdiğine dikkat çekilerek, konu, iç ve dış denetim boyutlarıyla birlikte incelenmektedir. Metinde, yapılan çözümlemeye dayalı olası sorunlar da ortaya konulmakta, bunlara dayalı çözümsel önerilere yer verilmektedir.

Abstract

The article draws attention to the public controlling system which will be re-formed as a part of the text/drait law on the reorganization of Turkish public administration. Turkish public administration system will be re-designed when the draft called as "The Basic Law for Public Administration" approved by the parliament. One of the subparts of this re-designing process is the controlling system. The public controlling system has no doubt its own problems. One of the leading reasons of the situation is relating with how the system was operated - rather than the system itself. So, the changes, for the controlling system that were proposed by the draft is evaluated in the article. To do this, firstly, a theoretical framework about the controlling system is presented. Then, the existing situation of the system and its problems are discussed from a macro point of view. Later, the expected controlling model is systematically analyzed. It is emphasized that the law leads to a radical transformation for the controlling system in terms of both its content and method. By this way, the topic is examined by considering the internal and external dimensions of the controlling system. Finally, after presenting some possible problems arising from the analysis made in the article, the analytical solutions for them are offered.
