Adli nitelikli ölümlerin belirlenmesi ve izlenecek yol

Özet

Hekimlerin mesleki, etik ve yasal yükümlülüklerinden biri de ölüm meydana geldiğinde ölümü belirlemek ve ölüm belgesi düzen- lemektir. Ölüm belgesi düzenlenirken hekime düşen en önemli görev ölüm tanısı koymak ve gerçekleşen ölümün doğal veya adli nitelikte olup olmadığının ayrımını yapmaktır. Sağlık kuruluşu dışında bu incelemeyi, toplum sağlığı merkezi (TSM), aile ve belediye hekimleri yapmaktadır. Ölüm sonrası muayene işlemlerinin uygun şekilde yapılmaması önemli hukuki sorunlara yol açabilir. Bu in- celeme oldukça önemlidir ve bazı noktalara dikkat edilmelidir. Bu yazıda ölümün adli nitelikte olup olmadığının tespitinde izlenecek yolların belirlenmesi amaçlanmıştır

Abstract

One of the ethical and legal obligations of physicians is to identify the death and to prepare death certificate when deaths occur. The most important duty of a physician while preparing the death certificates is diagnose the death and to distinguish whether it is a natural or forensic death. Outside the healthcare organizations, public health service or municipality physicians perform these exa- minations. If these examinations are not performed in the proper way during the postmortem examination processes, significant legal problems may occur. This examination is highly important and some points should be noted. In this article it is aimed to recognize the ways to be followed while deciding if the death is forensic or not
