Özet
Roma Hukuku temelli hukuk sistemlerinde güncel eğilim, miras bırakanın tasarruf özgürlüğünün genişlemesi, buna karşılık saklı pay kurumunun gerilemesidir. Fransa, Almanya, Belçika, İsviçre hukuklarında miras bırakanın tasarruf özgürlüğünü genişletmek adına çeşitli değişiklikler yapılmıştır. Türk Hukuku da bu eğilimden nasibini almış; sağ kalan eşin saklı payını artırırken, öncelikle 2002 yılında kardeşin saklı payını miras payının sekizde birine indirmiş; 2007 yılında ise kaldırmıştır. Saklı pay kavramının aile bağlarını kuvvetlendirme ve mirasçılar arasında dengeyi kurma amaçlarına hizmet ettiği çoğunlukla savunulmaktadır. Oysa aile kurumu, kapitalizmin bireye nüfuz etme hedefinde, iktisadî görevini baş rolde ifa etmekteydi. Bugün, mülkiyet iktisabına ve tüketime azmettirmede, gelişen iletişim ve reklâm olanakları, ailenin iktisadî görevini geri plana itmiştir. Kısacası, kapitalizm, bireyle iletişiminde, araç değiştirmiştir. Ailenin iktisadî görevi figüranlık mertebesine düştükçe, nihai hedefi global ekonomik sistemi kollamak olan ulusal miras hukuklarında, saklı payın gerilemesi de olağandır.
Abstract
The current trend in legal systems based on Roman law, is to expanse the freedom of the testator to dispose and in contrast to reduce the compulsory (reserved) share. In France, Germany, Belgium and Switzerland, the legislators made several changes in the name of expanding the freedom of the testator to dispose. Turkish law has also received a grant from this trend. While increasing the compulsory share of the surviving spouse, first in 2002, the sisters (and brothers) compulsory share was down to one-eighth of the hereditary share; than completely abolished in 2007. It has been often advocated that the concept of compulsory share serve to the purpose of strengthening family ties and establishing a balance between heirs. However, the family institution, in the target of penetration of capitalism to individuals, was performing the leading (chief) economic role. Today, with regard to the incitement to acquire property and to consume, developing communication and advertising opportunities, the economic role of the family has been pushed into the background. In short, for communicating with individuals, capitalism has changed ıts tool. As if the economic role of the family decreases (falls) into the range of walk-in, in the national inheritance law systems whose ultimate goal is to watch (look after) the global economic system, the decline of the compulsory share is ordinary.
