Özet
Ülkemizde kıyılara ilişkin özel bir sahiplik ve koruma vardır. Kıyılara ilişkin ana kurallar Anayasa ile belirlenerek, kıyılar anayasal güvenceye alınmıştır. Yasama organı Anayasa'nın verdiği yetkiye dayanarak kıyılara ilişkin temel düzenleme alanlarını 3621 say111 K1y1 Kanunu ile belirlemiştir. Kıyı Kanunu verdiği yetki çerçevesinde de idareye kıyılara ilişkin bazı kural koyma yetkileri tanınmıştır. Yasallık ilkesi gereğince, idare ve idarenin kural koyma yetkileri "yasa ve anayasaya aykırı olmama" şartı ile sınırlıdır. Ancak, Devletin hüküm ve tasarrufu altında bulunan kıyılar Maliye Bakanlığının düzenleyici bir işlemiyle kiraya verilebil-- mektedir. Son yıllarda kıyıların kiraya verilmesine ilişkin birçok uygulamanın da olduğunu görmekteyiz. Bu bağlamda çalışma kapsamında, 3621 sayılı Kıyı Kanunu kapsamına giren yerlerin kiraya verilmesine ilişkin idari düzenlemelerinin, idare huku-- kunda yasallık ilkesi açısından bir değerlendirilmesi yapılmıştır.
Abstract
A specific dominion and protection of coasts exists in our country. The basic rules about coasts are determined by the Constitution and coasts are under Constitutional protection. The legislative body determined the essential regulatory areas by the Coast Law (Number: 3621) on the basis of the authority granted by the Constitution. Authorization of setting certain rules is also given to the executive authority in accordance with the Coast Law. In accordance with the legality principle, administration and management of the rulemaking powers is limited by the requirement “not to be inconsistent with law and constitution” However the coasts under the provision and savings of the State can be rented by regulatory process of the Ministry of Finance. Many practices on leasing the coasts are frequently observed in the recent years. These leasing operations that take place in accordance with the rules set by the authority were not addressed. In this study, the evaluation of the regulations on leasing the places under the Coast Law (Number: 3621) in our country from the perspective of legitimacy principle in the administrative law.
