Özet
Çocuklar da tıpkı yetişkinler gibi temel insan hakları ve özgürlükle- rine sahiptir. Sahip oldukları bu hak ve özgürlüklerin gözetilmesi onların da toplum tarafından birer birey olarak kabulüne bağlıdır. Çalışmamızın konusu olan mülteci çocukların ise sosyolojik ve psikolojik olarak incin- meye daha çok müsait oldukları bir gerçektir. Ülkesinden ırkları, din- leri, belirli sosyal gruba mensubiyetleri ve sair sebeplerden ötürü haklı zulüm korkusu ile ayrılan ya da bu sebeplerden dolayı ülkelerine geri dönemeyen çocuklar, gittikleri ülkelerde statü belirleme aşaması dâhil olmak üzere bir dizi sorun ile karşılaşmaktadırlar. Çalışmamızda öncelikle mülteci, sığınmacı ve geçici koruma statü- sü kavramlarına değinilecektir. Bu kavramların çocuklar için herhangi bir değişiklik arz edip etmediği üzerinde durulacak ve mülteci çocuk- lara ilişkin uluslararası, bölgesel ve ulusal düzenlemeler incelenecek- tir. Statülerinin belirlenmesindeki usuller, 11.04.2014 yürürlük tarihli 6458 Sayılı Yabancılar ve Uluslararası Koruma Kanunu’nun (YUKK) hükümleri ile açıklanmaya çalışılacaktır. Sahip oldukları haklar özellikle Cenevre Sözleşmesi ve Çocuk Haklarına Dair Sözleşme bağlamında ele alınacaktır.
Abstract
Children have basic human rights and freedoms just like the adults. Protecting their rights and freedoms depends on their acceptance as in- dividuals by the society. It is a fact that the refugee children, who are the subject matter of our study, are more vulnerable sociologically and psychologically. The children, who leave their country with the well- founded fear of persecution because of their race, religion, connection to specific social groups and other reasons or who cannot return to their homeland because of such reasons, face a set of problems including the phase of determining their status at the country of arrival. Our study will first address to the concepts of refugee, asylum se- ekers and temporary protected status. We will mention whether those concepts make any difference for the children and we will examine the international, regional and national regulations with regards to the re- fugee children. We will seek to explain the procedures used in determi- ning the status through the Law no. 6458 on the Foreigners and Inter- national Protection that entered into force on 11.04.2014. Their rights will be discussed in the context of especially the Geneva Convention and Convention on the Rights of Children.
