Özet

Çalışmada Avrupa Birliği Adalet Divanı’nın 23 Şubat 2014 tarihli “Nils Svensson, Sten Sjögren, Madelaine Sahlman ve Pia Gadd, Retriever Sverige AB’ye Karşı” Kararı incelemeye tabi tutulmuştur. Avrupa Birliği Adalet Divanı’nın söz konusu kararında link verme yoluyla bir eserin başka bir internet sitesi bünyesinde internet kullanıcılarına sunulmasının eser sahibinin umuma iletim hakkını ihlal edip etmediği tartışılmaktadır. Bu açıdan mevcut çalışmada öncelikle karara konu olan uyuşmazlık başlığı altında uyuşmazlığa yol açan vakıalar, ulusal yargı mercilerinin çözümleri ve Avrupa Birliği Adalet Divanı tarafından çözümlenmesi beklenen ön sorunlar üzerinde durulmuştur. Daha sonra uyuşmazlığın hukuki çerçevesi çizilerek Adalet Divanı’nın ön sorunlara getirdiği çözümler çalışmaya aktarılmıştır. Son bölümde ise link verme kavramı ve link verme çeşitleri incelenerek, link verme yoluyla umuma iletim hakkının nasıl ihlal edilebileceği üzerinde durulmuş ve karara yönelik eleştiriler belirtilmiştir.

Abstract

In the study, the Case dated 13 February 2014 “Nils Svensson, Sten Sjögren, Madelaine Sahlman and Pia Gadd v. Retriever Sverige AB” of the Court of Justice of the European Union is examined. In this case, it is discussed whether the communication of the work to the internet users within another website via clickable link violates the right of communication to the public. In this respect, the present study primarily focuses on the facts leading to conflict, the solutions of national judicial authorities and the preliminary problems to be resolved by the Court of Justice of the European Union. Subsequently, the legal framework of the dispute is determined and the solutions brought to the preliminary problems of the Court of Justice are dedicated in the study. In the last section, the concept of linking and the types of linking are examined, the violation of the right of communication to the public via linking is discussed and criticisms about the decision are expressed.
