Özet

Osmanlı kadın tarihi üzerine yapılan çalışmaların sayısı her geçen gün biraz daha artmaktadır. Bu çalışmalar sayesinde, tarihte Osmanlı kadınının toplum içindeki yerleri ve rolleri hakkında bilgi edinilmektedir. Osmanlı kadın tarihi üzerine yazılan yazılar genellikle, kadınların ekonomik anlamda toplumsal üretime katkıları, sosyal alandaki varlıkları ve kadınların hukuksal haklarını kullanımı üzerinedir. Osmanlı toplumunda hukukun ve geleneklerin erkek iktidarına öncelik tanımasına rağmen kadınların kendilerine tanınan hakları kullandıkları bilinmektedir. En önemli hukuksal haklardan biri kadınların mahkemeye başvurabilmeleridir. Bu anlamda, Osmanlı kadınının bizzat kendileri ya da vekilleri aracılığıyla mahkemeyi sık sık kullandıkları bilinmektedir. Çalışmada, mahkeme ve kadın ikilemi üzerinden kadınların mahkemeyi neden ve nasıl kullandıkları anlatılacaktır. Çalışmanın ana kaynağı 210 Numaralı Kastamonu Şer’iyye Sicilidir. Sicil, 1732-1733 tarihlidir. Buna göre Kastamonu mahkemesi özelinde 1732-1733 yılları arasında bir yıllık süreçte kadınların mahkemeye yansıma süreci çalışmanın konusudur. Sicil, tarandığında belgelerin yaklaşık %80’inde kadınların var olduğu görülmüştür.

Abstract

The number of studies on the history of the Ottoman women is increasing every passing day. Owing to these studies, we obtain information about the place and role of the Ottoman women in society in the history. Articles on the history of the Ottoman women generally center upon women’s economic contribution to social production, presence in the social domain and use of their legal rights. Although the law and traditions in the Ottoman society prioritized men’s power, it was obvious that women used the rights which were accorded to them. One of the most important legal rights of women was to apply to a court. In this sense, it is known that the Ottoman women often used courts either on their own or via their attorneys. The purpose of the study is to discuss why and how women used courts on the basis of the dilemma of court and woman. Main reference of the study is the Kastamonu Court Records numbered 210 and dated 1732-1733. Accordingly, the study focuses on how the Ottoman women were present in courts between 1732-1733, specific to the Kastamonu court. Screening the records, it was seen that women were present in approximately 80% of the documents.
