Özet
Bu çalışmada velayetin tarihi süreçte hem süjesinin hem de içeriğinin değişimi ele alınmıştır. Bu bağlamda hem kaynak kanunda hem ülkemizde hem de uluslararası düzenlemelerdeki değişikliklere değinilmiştir. Velayetin özü aileye ve kişisel ilişkilere dayandığından aile ve psikolojiye ilişkin bilgi ve deneyimlerimiz farklılaştığında velayetin tanımının da değişeceği belirtilmiştir.
Abstract
In this article the change of the content and the subject of parental rights has been analyzed during the history. In this context, this process is mentioned in Turkish Law both in the reference Code -the Swiss Civil Codeand in the international texts. The essence of the parental right is based on the terms family and personal reletionship. Since our knowledge and experience about the family and psycology is changed it is for sure the definition of parental right must be changed as well.
