Özet

Kefalet sözleşmesi, Türk Borçlar Kanunu’nun 581-603. maddeleri arasında düzenlenmiştir. Türk Borçlar Kanunu’nun 581. maddesinde “Kefalet sözleşmesi, kefilin alacaklıya karşı, borçlunun borcunu ifa etmemesinin sonuçlarından kişisel olarak sorumlu olmayı üstlendiği sözleşmedir.” şeklinde tanımlanmıştır. Kefalet sözleşmesi, bir başkasının borcunu ifa etmemesi halinde bunun sonuçlarını kişisel olarak üstlenme anlamına geldiği için bu ilişkinin tarafları; kefil, asıl alacaklı ve asıl borçludur. Kefalet sözleşmesinin amacı ise alacağın teminat altına alınmasıdır. Kefalet sözleşmesi niteliği itibarı ile tek tarafa borç yükleyen ve ivazsız bir sözleşmedir. Kefalet borcu asıl borçtan bağımız bir para borcu olarak karşımıza çıkar. Yine kefalet sözleşmesinden kaynaklanan borç, tali (ikincil nitelikli) bir borç olma özelliği yanında, fer’i bir nitelik de taşımaktadır. Kefalet sözleşmesinin fer’iliği çalışmamızın temel konusunu oluşturmaktadır. Kefalet sözleşmesi mevcut ve geçerli bir esas borcun varlığını gerektirmektedir. Böylece kefilin yükümlülüğü asıl borçtan kaynaklanan yükümlülüğe bağlı olmaktadır. Çalışmamızda kefalet sözleşmesinin niteliği ve özelliklerine değindikten sonra, kefalet sözleşmesinin fer’iliği ilkesi, fer’i olmasına bağlanan sonuçlar ve kefalet sözleşmesinin fer’iliğinin istisnaları incelenmiştir.

Abstract

Bail contract, arranged between article 581-603 of the Turkish Code of Obligations. Article 581 of the Turkish Code of Obligations states that “the bail contract is a contract that the sponsor undertakes to be personally responsible for the consequences of the debtor's failure to pay debts.” Since the bail contract is meant to personally undertake the consequences of this if someone else does not fulfill the debt, the parties to this relationship; The guarantor, the principal creditor and the principal debt. The purpose of the bail contract is to secure it. The bail contract is a contract with a reputation for paying debt to one side. The bail is a debt owed to the original borrower as a money debt. The debt arising from the bailment contract is also a liability as well as a liability (secondary qualification). The nature of the bail contract constitutes the main point of our work. The bail contract requires the existence of a current and valid principal borrower. Thus the obligation of the guarantor depends on the obligation arising from the original debt. After touching on the nature and characteristics of the bail contract, we have examined the exceptions of the bail contract principle and the consequences of the bail contract and the bail contract.
