KÜRESEL BİR HUKUK DÜZENİ OLARAK LEX SPORTİVA

Özet

Spor 1980'li yıllardan itibaren, özellikle spor karşılaşmalarına yö- nelik medya ilgisi sayesinde, kayda değer bir önem kazanmıştır. Buna bağlı olarak spor ekonomisi önemli bir büyüme yaşamış ve Bosman kararı Avrupa Birliği içinde profesyonel sporcuların serbest dolaşımına katkı sağlamıştır. Bu şartlar altında spor hukuku devlet hukuklarına karşı belirli bir özerklik elde etmiş ve spora ilişkin kuralların uluslar üstü yapısı Spor Tahkim Mahkemesi ve Dünya Anti-Doping Ajansı gibi kurumların ortaya çıkmasıyla birlikte inkar edilemez bir gerçek haline dönüşmüştür. Günümüzde lex sportiva adı verilen uluslar üstü bir hukuk düzeninin varlığı, bu kavramın hukuki niteliği hala tartışmalı olsa da, tüm spor dünyası aktörleri tarafından kabul edilmektedir.

Abstract

From 1980s the sport has gained considerable importance in the world thanks to the media coverage of sporting events. Therefore, the sports economy has experienced remarkable growth and Bosman decision contributed to the free movement of professional athletes in the EU. Under these conditions the sports law got some autonomy from the state rights and transnational structure of sports rules has become an undeniable reality with the emergence of institutions such as the Court of Arbitration for Sport and the World Anti-Doping Agency. Nowadays the existence of a transnational legal order named lex sportiva was recognized by all actors of the world of sport even if the legal aspect of this concept is still questionable
