Özet
nevi tazminat talebinin ileri sürülemeyeceğini kabul etmektedir. Bu Yargıtay içtihadının gerekçesi ıslahın; hakkında usulüne uygun şekilde dava açılmış hususlarda mümkün olacağı, bu nedenle davanın başında ileri sürülmemiş manevi tazminat talebinin ıslaha konu oluşturamayacağıdır. Buna karşın Yargıtay, başka bazı davalarda aksi yönde kararlar vermekte, davanın başında ileri sürülmemiş farklı taleplerin ıslah ile davaya dâhil edilmesini kabul etmektedir. Yargıtay'ın manevi tazminat talebinin ıslah yoluyla ileri sürülemeyeceğine ilişkin kararları kanımızca usul ekonomisi ilkesine ve ıslahın amacına aykırıdır. Bu çalışmada, Yargıtay Hukuk Genel Kurulu'nun haksız fiilden kaynaklanan maddi tazminat davasında ıslah ile manevi tazminat ileri sürülemeyeceğine dair 2016 tarihli bir kararı incelenecektir
Abstract
For many years, the Court of Cassation held that a claim of nonpecuniary compensation cannot be submitted through the amendment of pleadings. The reason for these precedents is that the amendment of pleadings is possible for certain issues against which the action has been brought in a proper manner; so that the claim of non-pecuniary damages, which is not submitted at the very beginning of the action, cannot be a subject to the amendment of pleadings. On the other hand, the Court of Cassation, in some other cases, hold just the opposite viewpoint and decides that the claims that have not been filed at the beginning of the action are included in the action through the amendment of pleadings. The author is of the opinion that decisions of the Court of Cassation, with respect to nonpecuniary damages are contrary to the principle of procedural economy and the purpose of the amendment of pleadings. This article examines a decision of the General Assembly of the Court of Cassation dated 2016 regarding the refusal of claims for non-pecuniary damages through the amendment of pleadings in tort claim
