Özet
Sınırlı ağır usûlî hatalar sebebiyle kesinleşmiş bir mahkeme kararının ortadan kaldırılmasını amaçlayan yargılamanın yenilenmesi, Türk hukukunda sadece maddî anlamda kesinleşmeye elverişli hükümlere karşı kabul edilmektedir. Ancak, benzer usûlî hataların, tek başına maddî anlamda kesinlik etkisini haiz olmayan kanun yolu mahkemesi kararlarında da ortaya çıkması mümkündür. Bu nedenle, Kanun’un açıkça maddî anlamda kesinleşme sınırlaması yapmaması karşısında bu tür kararlara karşı da yargılamanın yenilenmesine başvurulabileceğini kabul etmek gerekir. Bu çerçevede, gerek bölge adliye mahkemesi gerekse Yargıtay tarafından kanun yolu incelemesi talebi üzerine verilen her çeşit karara karşı da yargılamanın yenilenmesine başvurulabilmelidir. Bu noktada, yenilenmesi talep edilen yargılama, ilgili sebebin ortaya çıktığı istinaf veya temyiz incelemesi olduğu için, bu sebebi incelemeye ve gerekirse önceki kararını kaldırarak yeni bir karar vermeye görevli ve yetkili mahkeme de ilgili kanun yolu mahkemesi olmalıdır. Böylece o kanun yolu mahkemesi, kanun yolunun niteliğine uygun ve kanun yolu incelemesi neticesinde verilebilecek bir karar verecektir.
Abstract
Retrail, which aimsto remove a judgement finalized with some severe and limited procedural mistakes, is accepted in Turkish law only for the judgements that is suitable for res judicita. However, the same severe procedural mistakes could appear at the decisions given by appeal courts, which are unsuitable for res judicata by its own. Therefore, in the light of the law, which does not explicitly limits retrail with res judicata, retrail should be applied against these kinds of judgements too. In this context, chance of retrail should be accepted against any judgements given upon the appeal request by both Regional Courts and Court of Cassation. In this case, because the trial that is subject to retrail is the appeal trail, which fails with the retrail reasons, coducted by the Regional Courts or Court of Cassation, competent court is the related RegionalCourt orCourt ofCassation, that islegally authorised to investigate the presented retrail reason and if necessarry to give a new ruling by removing the previous decision. Thus, related appeal court will be able to give a new ruling that is appropriate with the appeal proceeding.
