Özet
Hâkim durumun sözleşme yapmayı reddetme yoluyla kötüye kullanılması 4054 sayılı Rekabetin Korunması Hakkında Kanunu'nun "Hâkim Durumun Kötüye Kullanılması" başlıklı 6. maddesinde açıkça düzenlenmemiş olup, tamamen Rekabet Kurulu kararlarıyla ile şekillenmiştir. Bu ihlal türünün, sözleşme serbestisi ilkesine aykırı şekilde teşebbüslere sözleşme yapma yükümlülüğü getirmesi nedeniyle çok iyi bir şekilde değerlendirilmesi gerekmektedir. Bu kapsamda, zorunlu unsur doktrini geliştirilmiş ve ancak bir ürün veya hizmetin, bu ürün veya hizmeti talep eden teşebbüsün faaliyeti için zorunlu olması halinde böyle bir yükümlüğün getirilebileceği öngörülmüştür. Ancak sözleşme yapma yükümlülüğü sınırsız değildir ve ilgili ürün veya hizmeti sunacak teşebbüsün haklı bir gerekçe sunması halinde uygulanmayacaktır. Zorunlu unsur ve haklı gerekçenin ise neler olduğu ve nasıl değerlendirilmesi gerektiği Rekabet Kurulu tarafından belirlenmektedir. Bu çerçevede, bu ihlal türünün değerlendirilmesinde, Rekabet Kurulu kararları büyük önem arz etmektedir.
Abstract
Abuse of dominant position through refusal to supply is not regulated under Article 6 titled "Abuse of Dominant Position" of the Act on the Protection of Competition No. 4054 and has taken form through Competition Board's decisions. This infringement should be very well evaluated since it brings an obligation to supply to undertakings in a manner contrary to the principle of freedom of contract. Within this scope, the essential facility doctrine has been developed and it has been foreseen that such an obligation may be imposed only if the product or service is obligatory for the activity of the undertaking requesting those products or services. However, the obligation to supply is not unlimited and will not apply if the undertaking, which will supply the products or services submits efficiency claims. As for the content and evaluation of the essential facility and efficiency claim, they are determined by the Competition Board. Within this framework, in the evaluation of this infringement, Competition Board's decisions have huge importance.
