Özet

Hukuk tarihi ilkeleri nazara alınarak yapılan bu çalışmada, Osmanlı Devleti’nin önemli kurumlarından biri olarak kabul edilen kul sistemi incelenmiştir. Çalışmada literatürden, şer’iyye sicil kayıtlarından, mühimme defterlerinden ve Osmanlı dönemine ait Kanunnamelerden yararlanılmıştır. Gerek Türk gerek yabancı literatürde “devşirme” konusunu içeren eserler bulunsa da ortaya koyduğumuz çalışmada “kul sistemi” üzerinde durulmuş; meselenin yalnızca askeri boyutu ve sonuçları değil, idari yönü ve etkileri de incelenmiştir. Ayrıca sistemin ortaya çıkışından işleyişine, olumlu olumsuz yönlerinden Osmanlı devleti için nasıl bir değere sahip olduğuna kadar kapsamlı bir araştırma yapılmaya çalışılmıştır. Bunların dışında kul sisteminin İslam hukukuna aykırı olup olmadığı “zimmilik” ve “kölelik” başlıkları altında ayrıntılı olarak araştırılmış ve literatürdeki tezler incelenerek yeni bir takım bulgular ortaya konulmuştur. Kul sistemi, Osmanlı ordu teşkilatı ve idari örgütü içinde çok mühim bir yere sahiptir. Ancak sistemin İslam hukukuyla, özellikle zimmilik anlaşması ile, örtüşmeyen tarafları olduğu görülebilmektedir. Kul sisteminin bir kölelik modeli olmadığı; Osmanlı’ya has bir kurum olduğu anlaşılmaktadır. Kulun bazı durumlarda köleden daha aşağı, bazı hallerde hür ile köle arasında ve bazen hür bir vatandaştan daha üstün bir konumda bulunduğu ifade edilebilir. Kul sistemi günümüzün değil; yürürlükte olduğu dönemin toplumsal ve hukuki yapısı içerisinde değerlendirilmeye çalışılmıştır. İnsanı eğitme ve devlet hizmetine sunma usulü olarak Osmanlı Devleti’nde uzun yıllar başvurulan kul sisteminden hareketle bugün için söylenecek şudur: Yönetici kadrolara ve hatta devlet kurumlarına alınacak görevlilerin seçiminde özenli ve titiz bir yöntemin benimsenmesi gerekir ancak bunu yaparken hukuk sınırları içinde kalınmalı ve çıkabilecek hak ihlalleri en az seviyeye indirilmelidir.

Abstract

In this study, taking into account the historical principles of law, the kul system, which is considered as one of the important institutions of the Ottoman Empire, is examined. In the study, literature, Ottoman Judges (Qadı) records, state archives records and Ottoman Decree Law were used. Although there are a lot of works in Turkish and foreign literature that contain the subject of devshirme, in our study, “kul system” was emphasized; not only the military dimension and consequences, but also the administrative aspect and effects of the issue were examined. In addition, a comprehensive research has been carried out from the emergence of the system to its functioning, from its positive and negative aspects to its value for the Ottoman state. In addition those, whether the kul system is contrary to Islamic law were examined in detail under the headings of “dhimmitude” and “slavery”, and a number of new findings have been put forward by examining the theses in the literature. The kul system has a very important place in the Ottoman army organization and administrative organization. However, it can be seen that there are parties in the Islamic law that do not overlap with the “dhimmitude agreement”. It is understood that the kul system is not a model of slavery, it is indeed a unique instution to Ottoman Empire. It is concluded that “kul” is in a lower position than the slave, in some cases between the free and the slave and sometimes superior to a free citizen. Kul system is tried to be evaluated within the social and legal structure of the period in which it is in force, not today. The Ottoman Empire used the kul system for many years as a method of presenting people to education and service to the state, it should be mentioned that a careful and rigorous method should be adopted in the selection of officials to be recruited to administrative staff and even to state institutions, however, in doing so, it must be kept within the legal limits and any rights violations should be minimized.
