Özet
Mülkiyet hakkı, bir insan hakkı olarak 2709 sayılı 1982 Anayasası’nın 35. maddesinde ve Avrupa İnsan Hakları Sözleşmesi’nin 1 Numaralı Protokolü’nün 1. maddesi ile korunmaktadır. Anayasa’nın 90. maddesinin son fıkrası uyarınca, “Usulüne göre yürürlüğe konulmuş temel hak ve özgürlüklere ilişkin milletlerarası andlaşmalarla kanunların aynı konuda farklı hükümler içermesi nedeniyle çıkabilecek uyuşmazlıklarda milletlerarası andlaşma hükümleri esas alınır.” Bu bakımdan mülkiyet hakkını korumak, devletin hem pozitif hem de negatif yükümlülüğünü gerektiren bir haktır. Mülkiyet hakkına müdahale, imar uygulamaları ile yaygın şekilde gerçekleşmektedir. Bu sebeple Avrupa İnsan Hakları Mahkemesi’nin mülkiyet hakkını etkileyen imar uygulamalarına ilişkin içtihadı önem taşımaktadır.
Abstract
The right to property is protected as a human right by Article 35 of the 1982 Constitution numbered 2709 and Article 1 of Protocol No. 1 to the European Convention on Human Rights. Pursuant to the last paragraph of Article 90 of the Constitution, “In the case of a conflict between international agreements, duly put into effect, concerning fundamental rights and freedoms and the laws due to differences in provisions on the same matter, the provisions of international agreements shall prevail.” In this regard, protecting the right to property requires positive and negative obligations of the State. Intervention to the right to property is mostly realized through zoning practices. In this respect, the jurisprudence of the European Court of Human Rights concerning the zoning practices affecting the right to property is important.
