Özet

1989 anayasa reformu tek parti sistemini kaldırmış, ekonomik libe- ralizmi baştacı etmiş ve özellikle Hükümet başkanlığı ve Anayasa Kon- seyi gibi iki yeni kurum getirerek kurumsal düzenlemeleri Anayasaya sokmuştur. 1989 ve 1996 Anayasaları; Cumhurbaşkanından farklı ve arala- rında gerçek bir yetki paylaşımını sağlayarak kendisine münhasır yetki- ler verdiği Hükümet Başkanlığı kurumunu yarattı. Amaçlanan hedef; Cumhurbaşkanını, Devlet işlerinin günlük idaresiyle uğraşan bir organ olmaktan daha çok kurumların işleyişinin teminatı ve bir hakem olma- sını düzenleyerek yetkilerin adem-i merkeziyetini kurmak idi. İmtiyazla- rının sınırlandırılarak Hükümet Başkanına devri de bundan kaynaklanı- yordu. Bu durum 2008’e kadar sürecektir. Aslında, tüm beklentilere karşın, 2008 yılında, önceki reformların getirdiği ilerlemelere göre bir gerileme sayılacak, yeni bir anayasal re- forma girişildi. Bu reform; Cumhurbaşkanlığı yetki sürelerindeki sınırı kaldırmakta ve Hükümet Başkanlığını kaldırıp imtiyazlarını (eylem programının hazırlanması ve yürütme işlevinin geri alınması) Cumhur- başkanına aktararak, yerine Başbakanlığı getirmekte ve böylece erkleri Cumhurbaşkanında yeniden merkezileştirmektedir. Bununla birlikte, seçilmiş meclislerde temsil şanslarını artırarak “kadınların siyasi hakla- rının teşvik edilmesi hakkı”nı getirmektedir. Siyasi planda, siyasi parti kurma hakkını ilk defa düzenleyen 1989 Anayasasıdır, ki yeterince korunmamış bir hak olarak durmaktadır. Bir siyasi partinin kurulması başvurusunu kabul ya da reddi hususunda İçiş- leri Bakanı ölçüsüz yetkiler verilmiştir. Bu yöntem; bu özgürlüğün kul- lanılmasını, büyük ölçüde İçişleri Bakanının takdir yetkisine bıraktığın- dan, belirsizleştirmektedir. İdari yargıya başvuru mümkün olsa da; mev- cut hâliyle idari yargı, siyasi nitelikte bir uyuşmazlığı çözebilmek için, yeterince garanti altına alınmış tarafsızlık ve bağımsızlıktan yoksundur. 2012 tarihli Siyasi partilere ilişkin organik kanun reformu, siyasi partile- rin hukuksal statülerine ilişkin birkaç yenilik getirmesine karşın sistemin doğasına dikkate değer bir etkiden uzaktır. Şu var ki, mali yardımlar ile kitle iletişim araçlarına erişim hakkına bağlı sınırlandırmalardan ötürü, hâlâ dönüşümlü olmayan bir çokpartililikteyiz.

Abstract

RESUME La réforme constitutionnelle de 1989 a aboli le système de parti unique, a prôné le libéralisme économique et a introduit des réaménagements institutionnels notamment avec la création de deux nouvelles institutions, le Chef de Gouvernement et le Conseil constitutionnel. Les constitutions de 1989 et de 1996 ont créé l’institution du Chef du Gouvernement et lui ont affecté des compétences propres, distinctes de celles du président de la République, instituant par là un véritable partage de compétences entre les deux organes. L’objectif recherché était d’instaurer une déconcentration du pouvoir en faisant du président de la République beaucoup plus un arbitre et un garant du bon fonctionnement des institutions qu’un organe chargé de la gestion au quotidien des affaires de l’Etat. D’où la réduction de ses prérogatives et leur transfert au Chef du Gouvernement. Cette situation durera jusqu’en 2008. En effet, contre toute attente, une nouvelle reforme constitutionnelle est engagée en 2008, elle va constituer un recul par rapport aux avancées apportées par les deux réformes précédentes. Elle supprime la limitation des mandats présidentiels, et restaure la concentration des pouvoirs entre les mains du Président de la République en supprimant l’institution du Chef du gouvernement et son remplacement par un Premier ministre et le transfert des ses prérogatives au président de la République (élaboration du programme d’action et récupération de la fonction exécutive). Elle instaure, cependant, le “droit à la promotion des droits politiques de la femme” en augmentant ses chances d’accès à la représentation dans les assemblées élues. Sur le plan politique, c’est la Constitution de 1989 qui a institué pour la première fois le droit de créer des partis politiques, mais un droit qui reste insuffisamment protégé. Des pouvoirs exorbitants sont attribués au ministre chargé de l’Intérieur pour accepter ou refuser un dossier de création d’un parti politique. Cette démarche rend l’exercice de cette liberté aléatoire car dépendant, dans une large mesure, du pouvoir discrétionnaire du ministre de l’Intérieur. Un recours devant la juridiction administrative reste toujours possible, mais celle-ci ne présente pas, dans l’état actuel des choses, les garanties suffisantes de neutralité et d’indépendance pour résoudre un litige de nature politique. La réforme de 2012 de la loi organique relative aux partis politiques apporte quelques nouveautés concernant le statut juridique des partis politiques mais qui restent sans effets notables sur la nature du système. En effet, on est toujours en présence d’un multipartisme sans alternance en raison notamment des restrictions liées à l’accès au financement public et aux médias lourds qui demeurent toujours publics. ABSTRACT The constitutional reform in 1989 ended the single party period, favored economic liberalism and paved the way for the foundation of institutions like the Presidency and Constitutional Council. The constitutions of 1989 and 1996 created a Presidency (Head of Government) which is different from the President of the Republic. According to this change the president has exclusive authority. The purpose was to withdraw the President of the Republic from daily state issues and turn it into a referee, a guarantee for different state institutions to function properly, which would also increase decentralization. The limitation of authority and its transfer to the President was also a result of the same purpose. This situation was going to continue until 2008. Despite all the expectations in 2008 that a new political reform was started, it is going to be considered as a regression compared to previous ones. This reform removed the limits on the authority of the President of the Republic, abolished the presidency and transferred his power to the President of the Republic. According to this reform instead of a president, there would be a Prime Minister and political power would be centralized again in the hands of the President of the Republic. In addition, the reforms increased the chance for women to be elected for different councils (assemblies) thanks to “right to promote political rights for women”. In the political arena, the 1989 constitution was the first mention of the right to form a political party, which is a non-protected right. The Ministry of the Interior has unlimited authority to accept or decline the applications. This method prevents people to use this right freely and trusts the judgment of the minister. Even though it is possible to appeal to the juridical system, the administrative jurisdiction does not have the neutrality or the freedom to solve the disputes. Despite the organic law reform of 2012 regarding political parties, the system itself did not change. Because of limitations regarding financial support and mass communication, we can still talk about a multi-party regime without alternation.
