Özet

Tunus, tarihin en önemli diktatörlüklerinden birisini düşüren dev- rimden sonra, demokratik geçiş süreci yaşamıştır. Birlikçi, demokratik, sosyal, dünyevi, ya da tam olarak sivil, medeni bir anayasa talebiyle devrimi gerçekleştiren halk, sol eylemcilerden, işçilerden, işsiz genç diplomalılardan, kadın hareketleri aktivistlerinden ve insan hakları savunucularından oluşuyordu. Bu mücadele, ilkin devlet başkanlığı sta- tüsünün meşruluğunu ortadan kaldırmış ve diğer anayasal kurumlar üzerinde de domino etkisi göstermiştir. Devrimin ilk önemli anayasal adımı 3 Şubat 2011’te, geçici Cumhurbaşkanının kanun hükmünde ka- rarname çıkarmaya yetkili kılınması olmuştur. Bu yetki, cumhurbaşka- nını ilk geçiş döneminin gerçek yasa koyucusu haline getirmiştir. Ardın- dan çıkartılan ilk el metin niteliğindeki KHK’larla olağanüstü hal huku- kuna geçilmiş ve 1959 Tunus anayasası resmen askıya alınmıştır. Bu süreçte süregelen tartışmalarda devrimin motor güçleri, kurucu meclis, yeni anayasa ve demokratik seçimler mücadelesini sürdürmüşlerdir. Se- çimlerde ise, çoğu devrime hiç katılmamış ve daha çok seçim kampan- yalarında kandırılmış olan mukafazakar seçmenlerin En Nahda Partisine oy vermesi, bu partinin açık arayla birinci seçilmesine neden olmuştur. Devrim sürecinde insan hakları, demokrasi, çok partililik fikirlerini be- nimsediğini söyleyen İslamcı akım, seçim zaferinden sonra bu söylem- leri hızla terk etmiş ve genel politikasını köktenci bir hatta çekerek, İs- lamcılığı empoze etmek üzere baskı siyaseti uygulamaya başlamıştır. Bu yanıyla Ekim seçimlerinin sonuçları, Ocak devrimine sadakatsizlik taşı- maktadır ve bir karşı-devrim hareketine dönüşmek üzeredir.

Abstract

RESUME La transition démocratique en Tunisie, survenue à la suite d’une revolution qui a réusii d’une manière tout à fait surprenante à faire tomber une dictature des plus redoutables. Le message de la Révolution du 14 janvier 2011 était Claire: c’était à la foi un message unioniste, démocratique, sociale et temporel. Ce message n’avait adopté aucun slogan religieux et, parmi les acteurs qui ont soutenu concrètement la Révolution, ne figuraient que des partis d’extrème gauche et nationalistes, certaines ordres professionnels, le syndicat national des travailleurs. L’islamisme politique et les partis islamistes furent totalement absents. Alors que le parti islamiste semblait s’être rallié au courant démocratique et qu’il était favourable aux droits de l’homme, à la démocratie, à l’Etat de droit, au multipartisme, au caractère civil de l’Etat, on l’a vu renier ses engagements dès lendemian des elections de l’Assemblée Constituante qui a eu lieu le 23 octobre 2011. ABSTRACT Tunisia had a democratic transformation period after a revolution that ended one of the most important dictatorships. The crowd, after having created the revolution, was asking for a unifying, democratic, social, non-military and modern constitution. There were leftist activists, workers, unemployed young graduates, feminists and human right advocates. The struggle abolished the presidency and with its legitimization all the other constitutional institutions collapse like dominos. In the first important constitutional step of the revolution, the President of the Republic was granted the authority to issue decree laws. With this authority the PR became the first legislator of the transition period. The decree laws made possible the declaration of a state of emergency and the constitution of 1959 was officially suspended. The forces of the revolution kept on fighting for a constituent assembly, a new constitution and democratic elections. During the elections the conservatives, who did not join the revolutionary activities and were deceived by the political campaigns, voted for En Nahda Party, which saw all the secular parties as anti-Islamist parties. The Islamists won the elections, and despite their claims during the revolution regarding the internalization of human rights, democracy and multi-party system, after the elections they were fast enough to deny these concepts and move towards a fundamentalist approach, using Islamism as a way to create political pressure. In that sense, the elections in October are an act of disloyalty against the revolution, and have a counter-revolutionary character.
