Özet

Devlet Denetleme Kurulu, Türk İdari yapılanmasında ilk olarak 1982 Anayasası ile öngörülmüştür. Cumhurbaşkanlığı’na bağlı olan DDK’nin, Cumhurbaşkanı’nın emriyle harekete geçen bir dinamiği vardır. 6771 sayılı Türkiye Cumhuriyeti Anayasası’nda Değişiklik Yapılmasına Dair Kanun ile Devlet Denetleme Kurulu’na ilişkin Anayasa’nın 108. maddesi de değiştirilmiştir. Bunun üzerine Devlet Denetleme Kurulu’na ilişkin olarak 2443 sayılı Kanun döneminden, 5 sayılı CBK dönemine geçilmiştir. Söz konusu Cumhurbaşkanlığı Kararnamesi hükümleri incelendiğinde, Devlet Denetleme Kurulu’nun görev ve yetkilerinin genişlediği gözlemlenmektedir. Çalışma kapsamında, Kurul’un hukuki yapısı ile bazı görev ve yetkileri incelenecektir

Abstract

State Supervisory Council (SSC) was first stipulated by the 1982 Constitution in the Turkish administrative structure. The SSC which is affiliated to the Presidency has dynamic sacting on his orders. Article 108 of the Constitution regarding on the SSC wasamended by Law No. 6771 on the Amendment of the Constitution of the Republic of Turkey. Presidental Decree No.5 there up on entered in to force. When the provisions of the Presidential Decree are examined, it is observed that the dutie sand powers of the SSC have expanded. With in the scope of this study, the legal structure and some dutie sand powers of the Council will be examined.
